Source text - Spanish Mi nombre es XXXXXXXXXX, nací el 01 de marzo de 1968, en Venezuela, en la ciudad de Caracas. Mi madre se llama XXXXXXXXXXXXXXX y es residente permanente de los Estados Unidos. Tengo 4 hermanos. XXXXXXXXXXXXXXX, , quien es ciudadano americano, XXXXXXXXXXXXXX, quien reside en Canadá, XXXXXXXXXXXX , quien reside en Caracas, y XXXXXXXXXXX, quien reside en Venezuela. Estoy casada con XXXXXXXXXX desde el 07 de julio de 2000. Tengo 2 hijos, XXXX, de trece años de edad y XXXX, de doce años de edad. Ingresé a USA el 11 de noviembre de 2016 junto a mi esposo XXXXX y mis dos hijos XXXXX y XXXXX. Hago esta declaración en apoyo de mi solicitud para el asilo en los Estados Unidos.
Realicé estudios universitarios en la Universidad Simón Bolívar obteniendo el título de Ingeniero Químico en el año 1997. Trabajé durante aproximadamente un año en la industria alimentaria y en el año 2000 ingresé a trabajar en Bayer, compañía trasnacional alemana, desempeñando el cargo de representante de promoción médica (visitador médico) durante aproximadamente 15 años. Mis obligaciones como visitador médico requerían que durante la mayor parte del tiempo estuviera en las calles en barriadas populares. Las zonas que tenía designada para mi desempeño laboral en Bayer eran zonas en las cuales dominaban los simpatizantes del Presidente Chávez, y los movimientos de círculos bolivarianos y de colectivos armados “tupamaros” a quienes el Presidente les dio poder.
El Presidente Hugo Chávez durante su mandato siempre denigró la ocupación del visitador médico refiriéndose al visitador médico en cadena nacional con palabras ofensivas, tildándonos de escuálidos y “vagos con maleta”, desde ese mismo los grupos chavistas me veían con mi maleta y me insultaban en la calle gritándome “VAGA, ESCUÁLIDA, FUERA, FUERA DE AQUÍ, VETE ANTES DE QUE TE CAIGAMOS A GOLPES, NO TE QUEREMOS POR ESTOS LADOS”. Esto ocurría en las zonas donde debía acudir diariamente para realizar mi trabajo. Así me ocurría día a día, enfrentándome a insultos y vejaciones. En una ocasión al pasar por donde se realizaba una concentración chavista fui objeto de insultos y perseguida por dos personas con franelas rojas alusivas al partido de gobierno quienes me arrebataron mi maleta, la cual era mi instrumento de trabajo. Temiendo por mi seguridad me resguardé en un estacionamiento privado. A raíz de esta situación y temiendo por mi vida pedí a Bayer que lo más pronto posible me asignaran otra zona. Por el año 2004 me cambiaron de zona.
Viendo todos los atropellos de los cuáles éramos objeto a diario los visitadores médicos, comenzé a emprender, junto con algunos colegas, la lucha por defender nuestro derecho al trabajo. Es así como decidí ingresar a las filas del partido Acción Democrática que lucha por los derechos humanos y el restablecimiento de la democracia en el país. Durante el año 2004 participé en marchas opositoras para exigir el referendo revocatorio del Presidente Hugo Chávez.
Estando en una manifestación pacífica en contra del gobierno junto con varios integrantes del partido de Acción Democrática en Caracas, aparecieron más de 25 motorizados con camisas rojas alusivas al partido de gobierno, algunos con las caras tapadas con capuchas. Estos motorizados irrumpieron abruptamente en la concentración, de manera agresiva, portando armas de fuego, palos y piedras, empezaron a amenazar a todos los manifestantes, 15 acompañantes de los motorizados se bajaron y comenzaron a dividir la protesta a la fuerza, utilizando empujones y palos para golpear a algunos de los presentes. Estos motorizados al percatarse de que la policía municipal estaba llegando al lugar, montaron sus motos y huyeron de la manifestación. Después de esto, decidí involucrarme más en la lucha por nuestro país, participando, protestando pacíficamente y alzando la voz para defender nuestro derecho al trabajo y a la vida.
El 28 de agosto del 2005 la oposición organizó una marcha para llegar a la sede del parlamento y exigir la designación de nuevas autoridades electorales. Varias cuadras antes de llegar al edificio del parlamento, grupos oficialistas lanzaron bombas lacrimógenas, botellas y piedras contra nosotros los manifestantes, vimos que los cuerpos de seguridad no intervinieron para disolver el enfrentamiento. Tuvimos que huir del lugar.
Durante los siguientes días organizo en mi comunidad un grupo de compañeros del partido para recoger firmas para el asfaltado de Av. Principal de la zona en donde vivía (La Vega), algunas personas tomaron esta acción como manipulación política, presentándose al lugar en donde estábamos recogiendo las firmas en el sector La Vega, colectivos Tupamaros armados y de actitud grosera, humillante y amenazadora, gritando la siguiente frase “ contamos hasta diez para que se vayan de aquí malditos escuálidos, viva Chávez y la Revolución”, nos exigieron que entregáramos las carpetas con la información de las personas que habían firmado y es cuando uno de ellos pregunta: “¿quién es el encargado de esta vaina?”, di mi cara y dije : “yo soy”, y me preguntan:” ¿Quién eres tu?¿Quién te manó a hacer esto?, le respondí: “no me mandó nadie, estoy haciendo esto por mi comunidad, porque yo vivo aquí “ y en forma amenazante el sujeto me grita: “vete de aquí ya”, si no quieres amanecer con un mosquero en la boca tirada en la calle”.
A la semana siguiente me vi en la obligación de abandonar mi casa con mi familia. Encontré una nota en la puerta de mi casa que decía lo siguiente: “SABEMOS TODO SOBRE TI Y TU FAMILIA, SABEMOS A QUÉ HORA LLEGAS, A QUÉ HORA SALES Y EN DÓNDE DEJAS A TUS NIÑOS”. Me refugié en casa de mis padres, para estar más segura. Continué mis actividades políticas en contra del gobierno.
En una manifestación entre el 2006 - 2007 cuando me dirigía a mi vehículo, me di cuenta que me venían siguiendo, salí corriendo y me metí en un centro de comida rápida (Mc Donald`s), le dije al vigilante le lugar que me venían persiguiendo y amablemente me resguardó en la oficina de dicho local, llame a Polichacao, los cuales se presentaron al local antes mencionado y después de yo dar mi declaración me acompañaron hasta mi vehículo, al cual le habían desinflado tres cauchos y el vidrio de la parte trasera estaba roto y en el vidrio delantero marcado con spray blanco estaba escrito: “’¡TE SALVASTE POR HOY!”. Con este hecho sucedido, decidí pedir a mi empleador me trasladaran a una ciudad fuera de Caracas, y me trasladaron a la Isla de Margarita en junio de 2007.
Me residencié en la Isla de Margarita, continué realizando mis labores como Visitador Médico. Al mismo tiempo continué mi lucha política opositora.
En Margarita vivía en La Comarca, municipio García, dónde la mayoría de las personas son simpatizantes del gobierno. En ningún momento oculté mi ideología política. El 6 de diciembre de 2015, día de las elecciones de diputados a la Asamblea Nacional, salí a celebrar con un grupo de opositores el triunfo de la MUD (Mesa de Unidad Democrática), cuando nos encontrábamos dando un “cacerolazo”, llegaron colectivos armados (TUPAMAROS), hasta la puerta de mi casa, donde nos encontrábamos reunidos y con pistolas en mano nos apuntaron y a mí me dijeron que me fuera del barrio porque de lo contario la iba pasar muy mal. Al día siguiente, recibí una llamada a mi teléfono de un número que no se podía identificar, en la cual me decían que me matarían si no me iba de La Comarca.
El 7 de septiembre de 2016, me dirigí al aeropuerto Internacional Santiago Mariño para apoyar y acompañar a nuestro líder Enrique Capriles Radonsky, quien se encontraba sitiado por un grupo de motorizados encapuchados. En al aeropuerto, empezó una confrontación entre seguidores de Capriles y las bandas armadas chavistas. Después de esto, me dirigí a mi casa percatándome de que me seguía un par de motorizados, me dirigí al CICPC (CUERPO DE INVESTIGACIONES CIENTIFICAS PENALES Y CRIMINALISTICAS) para resguardarme y hacer la denuncia. La respuesta de ellos fue la denuncia no se podía realizar. Al no poder recibir apoyo del cuerpo de seguridad permanecí en el lugar por cuatro horas, hasta que mi esposo me fue a buscar. Esa noche por temor tuvimos que dormir fuera de nuestra casa.
El 01 de septiembre de 2016 la oposición convocó a una concentración en Caracas”, el objetivo de esta concentración era exigir el referendo revocatorio del Presidente Maduro, la libertad de los presos políticos, respeto a los derechos humanos y a la libertad de expresión. En Margarita se realizó una concentración en apoyo al partido MUD, ese mismo día. Decidí acudir a dicha concentración. Luego del mediodía y de estar en protestas, nos dirigíamos caminando en busca de nuestro vehículo. En el trayecto fuimos emboscados por unos motorizados, los cuales portaban armas de fuego. Empezaron a gritarnos y a agredirnos. Luego de esto, dos motorizados desenfundaron sus armas para amenazarlos, uno de ellos me agredió al yo preguntarle por qué nos atacaban. Mi esposo fue tirado al suelo y le dijeron que no se moviera porque de hacerlo le iban a disparar. Luego de esto me apuntaron a mí con un arma de fuego directamente a la cabeza pidiéndome que le entregara mi cartera. Procedieron a revisar mi identificación y uno de ellos me comentó: “TE TENEMOS FICHADA POR OPOSITORA Y ESCUÁLIDA VENDE PATRIA, SABEMOS QUIÉN ERES, EN DÓNDE VIVES, TENEMOS CARTA ABIERTA PARA MATAR A QUIÉN QUERRAMOS, ASÍ QUE SI TE VOLVEMOS A VER EN ALGUNA MARCHA PROTESTANDO, ESTÁS MUERTA”.
A mi esposo y a mí esta situación nos afectó muchísimo. Le agredieron a mi esposo y con una pistola, me apuntaron en la cabeza. Posterior a este incidente empezamos a recibir llamadas de números desconocidos. El sábado 3 de septiembre de 2016 estaba en una reunión familiar. Recibí una llamada donde proporcionaron datos como mi nombre, mi dirección y los lugares que frecuentaba con mi familia. En esta llamada me recalcaban que sabían quiénes éramos y que si nos veían nuevamente en la calle en algún acto político, nos matarían. Continuaron las amenazas vía telefónica, eran más agresivos y repetían que me matarían a mí y a mi esposo. Las llamadas nos volvieron aún más paranoicos cuando comenzaron a decirnos que nuestros hijos quedarían huérfanos. Sabían que teníamos dos hijos y sus nombres y en cual colegio estudiaban.
Desesperados, sin apoyo de los organismos de seguridad del estado, traté de concretar una cita con el alcalde del Municipio García; pensé que podía ayudarme. Cuando finalmente recibí información de parte del, me aconsejó no asistir a ninguna actividad política y que estuviese con cuidado en la calle, que no se podía hacer nada, que no había como detener la revolución.
Toda esta situación nos tenía con una paranoia constante, psicológicamente estábamos afectados. Salíamos de nuestra casa solo por necesidades básicas. El 19 de octubre de 2016, compramos los boletos con destino a Estados Unidos, sin decirle ni comentarle a nadie, solamente nuestros padres y hermanos. Por todo esto, se nos hace imposible volver a Venezuela, sabemos que la vida de nuestra familia corre peligro. Solicitamos de manera urgente el apoyo del asilo político en este país, que respeta los derechos humanos y es un país con democracia y libertad de expresión.
Translation - English (T. N.: This is the condensed History and Request for Asylum of XXXXXXXXX.)
My name is XXXXXXXXX. I was born on March l, 1968 in Caracas, Venezuela. My mother is named XXXXXXXXX and is a permanent resident of the United States. I have four brothers: XXXXXXXXX, who is an American citizen, XXXXXXXXX, who resides in Canada, XXXXXXXXX, who resides in Caracas and XXXXXXXXX, who resides in Nueva Esparta, Venezuela. I have been married to XXXXXXXXX since July 7, 2000. I have two children, XXXXXXXXX, thirteen years old and XXXXXXXXX, twelve years old. I came to the US on November 11, 2016 together with my husband, XXXXXXXXX and my two children XXXXXXXXX and XXXXXXXXX. I write this statement in support of my request for asylum in the United States.
I studied at the Simon Bolivar University and obtained a degree in Chemical Engineering in 1997. I worked for approximately one year in the food industry and in 2000 I started working at Bayer, a German transnational company where I was a representative promoting medical products, a Medical Sales Rep, for about 15 years. My duties as a Medical Sales Rep required me, most of the time, to be traveling around in working class neighborhoods. These areas that I was assigned to work in for Bayer, were areas dominated by President Chavez sympathizers, and the ‘Bolivarian Circles’ movements, and armed ‘colectivos’ (T. N.: government gangs) ‘Tupamaros’ who were empowered by the president.
President Hugo Chavez, during his mandate, always degraded the Medical Sales Rep position and referred to it on national television with offensive language, labelling us as ‘squalids’ (T. N.: dirty opposition) “loafers with briefcases”. Right away, the Chavista groups that saw me with my briefcase would insult me and scream, “Lazy squalid, get out of here, leave before we beat you up. We don’t want you around here.” This would happen day after day, in the areas where I had to go, to do my work; I had to face insults and harassment.
At one point, I had to pass by an area where a Chavista gathering was taking place, and I became the object of insults and was followed by two people in red shirts, indicating affinity with the government party, who grabbed my briefcase. This was a tool for my work. I feared for my safety so I hid in a private parking garage. After that situation, in fear for my life, I asked Bayer to assign me to another area as soon as possible. I was moved to another area in 2004.
Seeing all the abuse we Medical Sales Reps were subjected to on a daily basis, I started with some other colleagues, to take up the fight in defense of our right to work. That was when I decided to join the ranks of the ‘Accion Democratica’ party that fights for human rights and the re-establishment of democracy in the country. During 2004, I participated in opposition marches to demand the recall referendum on President Hugo Chavez.
While I was at a peaceful protest against the government, together with several members of the ‘Accion Democratica’ party in Caracas, over 25 aggressive motorcyclists appeared wearing red shirts that indicate affinity with the government party. Some of them had their faces covered with hoods. These motorcyclists abruptly and aggressively burst in on the demonstration with firearms, sticks and stones. They started threatening the protesters. About fifteen of the motorcyclists got off their bikes and started to break up the protest by force, pushing and hitting people with their sticks. When they realized the municipal police were coming, they got back on their bikes and fled the demonstration. After this I decided to get even more involved in the battle for our country, participating and protesting peacefully and raising my voice to defend our right to have work and life.
On August 28, 2005, the opposition organized a march that led to Parliament headquarters to demand the appointment of new electoral authorities. Several blocks before reaching the Parliament building, government party members threw tear gas bombs, bottles and rocks at us, the protesters. We watched as the security forces did nothing to diffuse the confrontation. We had to run away from there.
A few days later, I organized a group in my community, together with some fellow party members, to get signatures for the paving of the main road of the area where I lived, La Vega. Some people took this as political manipulation and came to the area where we were gathering signatures in La Vega. Some armed ‘Tupamaro Colectivos’ with a foul, humiliating and threatening attitude, screamed, “We’re going to count to ten so you can all leave, you damned filthy opposition; long live Chavez and the Revolution”. They made us turn over the binders with the information on the people who had signed. One of them asked, “Who organized this mess?”, and I answered, “I did.” They said, “Well get out of here if you don’t want to wake up dead!”
A week later I had to leave my house with my family. I found a note on the door that said, “We know everything about you and your family. We know when you get home, when you leave and where you leave your children.” I sought refuge at my parents’ house for my safety, and continued my political activities against the government attending opposition protests during 2006 and 2007.
After one of these protests, when heading for my car, I noticed some people following me. I took off running and got into a fast food place, a McDonalds. I told the guard that I was being followed and he let me stay in the office. I called the police and they came to the restaurant. After taking my statement they walked me to my vehicle. They had let the air out of three tires and the back windshield was broken. The front windshield had a sign on it in white spray paint, “YOU ESCAPED, TODAY!” After this, I asked my employer to transfer me out of Caracas, and they transferred me to Margarita Island in June, 2007.
I took up residence on Margarita Island and continued my work as a Medical Sales Rep. At the same time, I continued my fight as political opposition.
On Margarita, I lived in ‘La Comarca’, Garcia Municipality, where most of the people are government sympathizers. I never hid my political ideology. On December 6, 2015, Election Day for the representatives in the National Assembly, I went out to celebrate with a group from the opposition, the success of the MUD (Coalition for Democratic Unity). We were demonstrating with loud banging of pots and pans when some armed ‘Tupamaro Colectivos’ showed up at the door of my house where we were gathered, pointing pistols at us. They said that I had better leave the neighborhood, because if not, I was going to be in trouble. The next day I got a call on my phone from a number I did not know, where I was told that I would be killed if I did not leave ‘La Comarca’.
On September 1, 2016, the opposition called for a demonstration in Caracas, the object of which was to demand a recall referendum of President Maduro, freedom for political prisoners, respect of human rights and freedom of speech. In Margarita, we also had a demonstration supporting the MUD on the same day. I decided to go to the demonstration. After noon, and after having been at the protest, we were on our way to our vehicle. On the way, we were ambushed by aggressive motorcyclists carrying firearms. They started to scream at us and assault us. After that, two of them drew their weapons to threaten us and one of them assaulted me when I asked him why they were attacking us. They threw my husband to the ground and told him not to move otherwise they would shoot. After this they pointed their weapon directly at my head telling me to hand over my purse. They checked my identification and one of them said, “We have you pegged for being filthy opposition, traitor. We know who you are, where you live. We have carte blanche to kill whoever we want, so if we see you protesting again at any march, you are dead.”
This situation really bothered my husband and me a lot. My husband was assaulted, and a gun was pointed at my head. After this incident we started to get phone calls from unrecognized numbers. On Saturday, September 3, 2016, while at a family reunion I got a phone call where I was told facts like my name, my address, the places I frequented with my family. During that call they reiterated that they knew who we were, and that if they saw us again at any political function, they would kill us. These threats continued via telephone; they were getting more aggressive and they continued repeating that they would kill me and my husband. The calls made us even more paranoid when they started to say, your children will be orphans. They knew we had two children, their names and where they went to school.
On September 7, 2016, I was on my way to the Santiago Mariño international airport to support our leader Enrique Capriles Radonsky who was besieged by a group of aggressive hooded motorcyclists. There was a confrontation at the airport between the Capriles followers and the armed Chavista bands. After this I was on my way home when I realized I was being followed by a couple of these aggressive motorcyclists. I went to the CICPC (Scientific, Penal and Criminal Investigative Body) for protection and to file a complaint. The answer I received was that I could not file a complaint as I did not have the motorcycle tag number. Because I could not receive any help from this security force, I stayed there for four hours until my husband came to get me. That night we had to spend the night away from our house.
We were desperate. We had no support from the state security forces. I tried to set up an appointment with the Mayor of the Garcia Municipality; I thought he could help me. When I finally heard from him, through his secretary, he advised me to not go to any more political activities, and to be careful on the street. He said nothing could be done, that there was no way to hold back the revolution.
This whole situation kept us constantly paranoid and we were psychologically unnerved. We would leave our house only for basic necessities. On October 19, 2016 we bought tickets for a flight to the US without telling anyone, just our parents and siblings. For all these reasons, it has become impossible for us to return to Venezuela. We know our family’s lives are in danger. We urgently request your help through political asylum in this country that respects human rights and is a democratic country with freedom of speech.

STATEMENT OF SUBJECT MATTER AND APPELLATE JURISDICTION
This case arises from the criminal prosecution of the Appellant, together with multiple co-defendants, in the United States District Court for the District of South Carolina, XXXXXXX Division. Mr. XXXXX was charged with other co-defendants in a single count indictment filed on September 15, 2015. (ECF 3) The defendants were charged with conspiracy to possess with intent to distribute and distribution of cocaine, in violation of Title 21, United States Code, §§ 841(a)(1) and 841(b)(1)(B) all in violation of Title 21, United States Code, § 846. (ECF 3)
On January 19, 2016 Mr. XXXXX was charged in three counts of an eight- count superseding indictment with conspiracy to possess with intent to distribute and distribution of cocaine, in violation of Title 21, United States Code, §§ 841(a)(1) and 841(b)(1)(C) in violation of Title 21, United States Code, § 846; possession with intent to distribute cocaine in violation of Title 21, United States Code, §§ 841(a)(1) and 841(b)(1)(C); and, possession of a firearm in furtherance of a drug trafficking crime in violation of Title 18, United States Code, § 924(c)(1)(A)(i). The Government also sought forfeiture of certain assets. (ECF 87)
On July 8, 2015, Mr. XXXXX pled guilty to Count 1 (ECF 116, 117) of the superseding indictment pursuant to the terms of a plea agreement which was filed

on March 23, 2016. (ECF 109) Mr. XXXXX was sentenced on August 23, 2016 to 72 months in prison followed by a term of supervised release of 4 years. (ECF 160, 171) The written judgment was entered on August 26, 2016 (ECF 171) and Mr. XXXXX timely filed his notice of appeal on September 1, 2016. (ECF 177)
The Court of Appeals has jurisdiction over this matter pursuant to 28 U.S.C. §§ 1291 and 18 U.S.C. § 3742.
STATEMENT OF THE ISSUES
The issues raised in this appeal are whether the District Court fully complied with the requirements of Rule 11 of the Federal Rules of Criminal Procedure in accepting the defendant’s guilty plea, and whether his sentence was reasonable.
STATEMENT OF THE CASE AND FACTS
According to information provided to several federal agencies, Mr. XXXXX was identified as a participant in a drug trafficking conspiracy which acquired and distributed multi-kilogram quantities of cocaine throughout the XXXXX, XXXXX, and XXXXXX County areas of South Carolina. (PSR 8)
During winter of 2014, the FBI and the DEA initiated an investigation into drug trafficking activities of several individuals in the XXXXXX and XXX County areas of South Carolina. As part of their investigation, FBI and DEA agents sought and obtained a federal court order authorizing the interception of wire communications on cellular phones utilized by several individuals, including XXXXX

XXXXX. Evidence collected from these intercepted calls revealed XXXXX was being supplied with kilogram quantities of cocaine by XXXXX and his son, xxxxx. Based on the information derived from intercepted calls from XXXXX’s phone, FBI and DEA agents sought and obtained a federal court order authorizing the interception of wire communications on cellular phones used by XXXXX and his cocaine supplier, XXXXX. Through the use of intercepted wiretap communications, surveillance, the execution of search warrants, and other corroborating investigative techniques, federal agents learned XXXXX stored large quantities of cocaine which he supplied XXXXX at a U-Haul Storage Facility located in XXXXXXXX, South Carolina. Between January 2, 2015 and July 24, 2015, federal agents intercepted approximately 28 telephone calls which provided details of XXXXX’s drug trafficking activities with XXXXX and xxxxx. During these calls, XXXXX, XXXXX, and XXXXX regularly discussed the acquisition and distribution of multi-kilogram quantities of cocaine. (PSR 8)
Federal agents, from May 2015 through August 2015, intercepted telephone calls and text messages which detailed drug trafficking activities between XXXXX, XXXXX, XXXXX, and Mr. XXXXX. Specifically, between July 12, 2015, and July 14, 2015, federal agents intercepted

several phone calls and text messages establishing that Mr. XXXXX facilitated a transaction involving two kilograms of cocaine which was supplied to xxxxx. (PSR 8)
On October 20, 2015 law enforcement executed a federal arrest warrant for Mr. XXXXX in Columbia, SC. Upon arrival, officers spoke with xxxxx at the front door and noticed Mr. XXXXX standing behind her. Mr. XXXXX was taken into custody. After being advised of his Miranda Rights, Mr. XXXXX admitted illegally entering the United States from Mexico at the Arizona border and traveling to South Carolina in 2004. Mr. XXXXX informed law enforcement that a shotgun was located in the bedroom of XXXXX’s children and indicated the shotgun, along with a bag of ammunition, belonged to someone else. Mr. XXXXX also advised that his cousin previously stayed in the trailer and left behind a quantity of cocaine in the master bedroom. Mr. XXXXX consented to a search of the trailer and his car parked outside. (PSR 9)
While searching the trailer law enforcement located a Mossburg 12-gauge shotgun loaded with four shells, along with two shotgun shells in a child’s bedroom, two digital scales, a box of plastic bags, a bag containing various rounds of ammunition, and approximately 33 grams of cocaine in the master bedroom of the trailer. (PSR 9)

In October, 2015 XXXXX entered into a proffer agreement and was interviewed about drug trafficking activities in the XXXXXXand XXXXXX County areas of South Carolina. XXXXX stated that he obtained cocaine from Mr. XXXXX on approximately 10 occasions in 2014. XXXXX initially received one ounce of cocaine, then two-to-three ounces on other occasions, then one-half of a kilogram once before eventually purchasing one kilogram quantities of cocaine on two occasions from Mr. XXXXX. XXXXX told authorities that he met with Mr.XXXXX’s cocaine source, XXXXX, along with Mr. XXXXX to negotiate a better price on the cocaine, after which time XXXXX began dealing directly with XXXXX. (PSR 9)
On January 19, 2016 Mr. XXXXX was charged in three counts of an eight- count superseding indictment with conspiracy to possess with intent to distribute and distribution of cocaine, in violation of Title 21, United States Code, §§ 841(a)(1) and 841(b)(1)(C) in violation of Title 21, United States Code, § 846; possession with intent to distribute cocaine in violation of Title 21, United States Code, §§ 841(a)(1) and 841(b)(1)(C); and, possession of a firearm in furtherance of a drug trafficking crime in violation of Title 18, United States Code, § 924(c)(1)(A)(i). The Government also sought forfeiture of certain assets. (ECF 87)

On July 8, 2015, Mr. XXXXX pled guilty to Count 1 (ECF 116, 117) of the superseding indictment pursuant to the terms of a plea agreement which was filed on March 23, 2016. (ECF 109)
Mr. XXXXX was sentenced on August 23, 2016. (ECF 160) The Presentence Investigative Report indicated (based on an adjusted total offense level of 27 and criminal history category of I) that the guideline range was 70 to 87 months. (ECF 189, pp. 4-5, PSR 13)
Judge X sentenced Mr. XXXXX to 72 months in prison followed by a term of supervised release of 4 years. (ECF 160, 171, 189 , pp. 16 - 17 ) The written judgment was entered on August 26, 2016. (ECF 171) Mr. XXXXX timely filed his notice of appeal on September 1, 2016. (ECF 177)
Counsel has reviewed the records of this case, researched the issues raised by Mr. XXXXX and found them to have no merit. Therefore, this brief is submitted pursuant to Anders v. California, 386 U.S. 738 (1967). The issues raised in this appeal is whether the district court complied with the requirements of Fed. R. Crim. P. 11 in accepting the Appellant’s guilty plea and whether his sentence was reasonable.

SUMMARY OF ARGUMENT
ARGUMENTI: A review of record indicates the district court fully complied with the requirements of Rule 11 of the Federal Rules of Criminal Procedure when the court accepted the defendant’s guilty plea. ARGUMENT II: A review of the record also indicates that the district court’s sentence was procedurally and substantially reasonable.
STANDARD OF REVIEW (ARGUMENT I)
Generally, the standard of review as to whether the district court adequately complied with Rule 11 of the Federal Rules of Criminal Procedure is de novo. United States v. Good, 25 F.3d 218, 219 (4th Cir., 1994). Rule 11 provides that “a variance from the requirements of this rule is harmless error if it does not affect substantial rights. In the absence of an attempt to withdraw a defendant’s guilty plea, Rule 11 violations are reviewed for plain error. United States v. Martinez, 277 F.3d 517 (4th Cir., 2002). To meet the plain error standard, Appellant must show that there was (1) error; (2) that it was plain; and that (3) affected his substantial rights. United States v. Olano, 597 U.S. 725, 732 (1993).
I. DID THE DISTRICT COURT FULLY COMPLY WITH THE REQUIREMENTS OF RULE 11 OF THE FEDERAL RULES OF CRIMINAL PROCEDURE WHEN THE COURT ACCEPTED THE DEFENDANT’S GUILTY PLEA?
Rule 11(b)(1) of the Federal Rules of Criminal Procedure requires that, before accepting a plea of guilty, the court must address each defendant personally

in open court and inform the defendant of, and determine that the defendant understands, the following:
(A) the government’s right, in a prosecution for perjury or false statement, to use against the defendant any statement that the defendant gives under oath;
(B) the right to plead not guilty, or having already so pleaded, to persist in that plea;
(C) the right to a jury trial;
(D) the right to be represented by counsel-and if necessary have the court appoint counsel-at trial and at every other stage of the proceeding;
(E) the right at trial to confront and cross-examine adverse witnesses, to be protected from compelled self-incrimination, to testify and present evidence, and to compel the attendance of witnesses;
(F) the defendant’s waiver of these trial rights if the court accepts a plea of guilty or nolo contendere;
(G) the nature of each charge to which the defendant is pleading;
(H) any maximum possible penalty, including imprisonment fine, and term of supervised release;
(I) any mandatory minimum penalty;
(J) any applicable forfeiture;
(K) the court’s authority to order restitution;

(L) the court’s obligation to impose a special assessment;
(M) the court’s obligation to apply the Sentencing Guidelines, and the court’s discretion to depart from those guidelines under some circumstances; and
(N) the terms of any plea-agreement provision waiving the right to appeal or to collaterally attack the sentence.
(O) that, if convicted, a defendant who is not a United States citizen may be removed from the United States, denied citizenship, and denied admission to the United States in the future.
Rule 11(b)(2) requires the court to determine the plea is voluntary and that the plea “did not result from force, threats, or promises other than promises in a plea- agreement.”
Rule 11(b)(3) requires the court to determine that there is a factual basis for the plea before entering judgment.
Rule 11(c)(2) requires the parties to disclose the plea agreement in open court when the plea is offered unless the court for good cause allows the parties to disclose the plea agreement in camera.
Rule 11(c)(3)(B) requires that to the extent a defendant’s plea-agreement is of the type specified in Rule 11(c)(1)(B), the court must advise the defendant that the defendant has no right to withdraw the plea if the court does not follow the recommendation or request.

During the Rule 11 proceeding in this case, the court placed Mr. XXXXX
under oath and informed him that any statement he gave under oath could be used against him as required by Rule 11. (ECF 191, p. 4)
The court informed Mr. XXXXX of his right to plead not guilty, his right to have a jury trial, and his right to be represented by counsel. (ECF 191, pp. 21-22)
The court also informed Mr. XXXXX of his rights associated with having a trial such as the right to confront and cross examine adverse witnesses, to testify and present evidence, to compel the attendance of witnesses. (ECF 191, pp. 21-22)
The court ensured that Mr. XXXXX understood he would be waiving his rights to a jury trial and all of the rights associated with a jury trial if the court accepted his guilty plea. (ECF 191, pp. 21-22)
The court informed Mr. XXXXX of the nature of the charges to which he was pleading guilty. (ECF 191, pp. 8, 9, 22-24) The court informed Mr. XXXXX of the maximum possible penalty of imprisonment, fine and supervised release. (ECF 191, pp. 24-25) The court further informed Mr. XXXXX of the court’s obligation to apply the Sentencing Guidelines, and the court’s discretion to depart from the guidelines in some circumstances. (ECF 191, pp. 17- 20)
Mr. XXXXX’s plea agreement was summarized in open court. (ECF 191, pp. 9-12)

The court reviewed the maximum penalties for the offense to which Mr. XXXXX entered his plea, including the special assessment and the mandatory minimum sentence in this case. (ECF 191, pp. 24-26)
The district court judge reviewed the waiver of appeal provision with Mr. XXXXX. (ECF 191, p. 11, 13-14)
The district court judge reviewed and ascertained that Mr. XXXXX knew and understood the forfeiture provisions in the plea agreement. (ECF 191, pp. 11, 13)
Restitution was not an issue so the court did not advise Mr. XXXXX of its authority to order restitution pursuant to Rule 11(b)(1)(K). (PSR 15)
The court advised Mr. XXXXX that he could potentially be removed from the United States, and that his guilty plea would result in adverse immigration consequences in the future pursuant to Rule 11(b)(1)(O). (ECF 191, p. 15)
Before entering judgment, the court determined that there was a factual basis for the plea. (ECF 191, pp. 26-32)
The court determined that Mr. XXXXX’s guilty plea was knowingly, voluntarily, and intelligently made with full knowledge of all the consequences that could result from the plea, and did not result from force, threats or promises other than promises contained in his plea agreement. (ECF 191, pp. 11, 13, 15, 21- 26)

Rule 11(c)(3)(B) requires that to the extent a defendant’s plea-agreement is of the type specified in Rule 11(c)(1)(B), the court must advise the defendant that the defendant has no right to withdraw the plea if the court does not follow the recommendation or request. The plea agreement did not contain provisions specified in Rule 11(c)(1)(B).
It therefore appears that the district court fully complied with Rule 11 when the court accepted Mr. XXXXX’s guilty plea.
STANDARD OF REVIEW (ARGUMENT II)
The court reviews a sentence for reasonableness focusing on whether the district court abused its discretion. Gall v. United States, 128 S. Ct. 586, 597 (2007), United States v. Pauley, 511 F.3d 468, 473 (4th Cir., 2008).
II. WAS THE DISTRICT COURT’S SENTENCE REASONABLE?
“When sentencing a defendant, a district court must: (1) Properly calculate the guidelines range; (2) determine whether a sentence within that range serves the factors set out in 18 U.S.C. § 3553(a); (3) implement mandatory statutory limitations; and, (4) explain its reasons for selecting a sentence.” United States v. Green, 436 F.3d 449 (4th Cir.), cert. denied, 126 S. Ct. 2309 (2006).
The district court judge commenced the hearing by ensuring that Mr. XXXXX and his attorney had reviewed the Presentence Investigation Report (ECF 189, pp. 2-3) Mr. XXXXX’s attorney withdrew his objections to a firearm

enhancement contained in the presentence report. Judge X ensured that Mr. XXXXX agreed to his attorney’s withdrawal of the objections. (ECF 189, p. 3-4)
After accepting the legal and factual conclusions in the presentence investigation report without objection, the district court judge calculated the applicable sentencing guideline level. (ECF 189, p. 4) In determining his attributable drug amounts for guideline sentencing purposes, Mr. XXXXX was held accountable for the quantity of cocaine derived from intercepted wiretap communications, the quantity of cocaine seized from his residence in October 2015, and the quantities attributed to him during XXXXX’s proffered interview which totaled 4.673 kilograms of cocaine. (PSR 9) The Probation Officer calculated a base level of 28, added 2 points for possession of a firearm, and deducted 3 points for acceptance of responsibility. (PSR 11) Mr. XXXXX’s criminal history score was computed correctly using appropriate Chapter 4 calculations in the United States Sentencing Guidelines, for a resulting criminal history category of I. (PSR 10-11) The Presentence Investigative Report indicated (based on an adjusted total offense level of 27 and criminal history category of I) that the guideline range was 70 to 87 months. (ECF 189, pp. 4-5, PSR 13) In reviewing a sentence, this Court should first determine whether the sentence was procedurally reasonable, for example that there are no errors in the guidelines calculation; because the advisory sentencing guidelines were correctly calculated,

it appears the sentence was procedurally reasonable. United States v. McGee, 736 F.3d 263, 271 (4th Cir. 2013).
Counsel for Mr. XXXXX then made an oral motion for a downward variance. Counsel advised the court that Mr. XXXXX was an employed construction worker in the spring of 2015 with a severe cocaine habit. Counsel alleged that Mr. XXXXX used a large amount of cocaine but received no payment for it, and did not support his family with funds acquired from sales of cocaine. While counsel conceded that Mr. XXXXX had 33 grams of cocaine in his residence when it was searched, but that cocaine was primarily for his personal use. Counsel also noted that Mr. XXXXX had not been paid for drug transactions between other parties. Counsel claimed that the shotgun, also discovered during the search of Mr. XXXXX’s residence, was being held for someone else. (ECF 189, pp. 5-8)
Counsel for the Government responded that the facts alleged by Mr. XXXXX’s counsel were inconsistent with facts found in paragraphs 20 and 21 in the PSR to which no objection had been made. (ECF 189, pp. 5-8) Counsel for the Government also noted that, although Mr. XXXXX may have been a substantial user of drugs, he was only being held accountable for drugs he actually distributed or drugs that he actually brokered and was not being held accountable for a considerable amount of drugs for which he could have been held accountable.

Therefore, the 18 U.S.C. § 3553 factors did not support a downward variance sentence. (ECF 189, 9 -12)
Judge X denied the defendant’s motion for downward variance based on the fact that Mr. XXXXX actually handled or personally participated in the drug quantity for which he was being held accountable. Judge X then thoroughly reviewed the applicable sentencing factors listed under 18 U.S.C. § 3553, and sentenced Mr. XXXXX to 72 months in prison followed by a term of supervised release of 4 years. (ECF 160, 171, 189, pp. 12 - 16) The written judgment was entered on August 26, 2016. (ECF 171)
The judge adequately addressed 18 U.S.C.A. § 3553. “Under Gall, we must first ‘ensure that the district court committed no significant procedural error.” United States v. Seay, 553 F.3d 732 (4th Cir., 2009). “A sentence may be procedurally unreasonable, for example, if the district court provides an inadequate statement of reasons or fails to make a necessary factual finding.” United States v. Moreland, 437 F.3d 424 (4th Cir. 2006).
The district judge’s recitation that he had considered the 3553(a) factors was an adequate statement of reason. (ECF 189, p. 16) Judge X thoroughly reviewed the 3553 factors applicable to Mr. XXXXX. (ECF 189, pp 12 – 16)
“Sentencing courts are statutorily required to state their reasons for imposing sentence. See 18 U.S.C.A. § 3553(c) (West Supp. 2009). Although a comprehensive, detailed opinion is not necessarily required, the court’s explanation must nonetheless be sufficient ‘to

satisfy the appellate court that [the district court] has considered the parties’ arguments and has a reasoned basis for exercising [its] own legal decision making authority.’ Rita v. United States, 551 U.S. 338, 356, 127 S.Ct. 2456, 168 L.Ed.2d 203 (2007)”
United States v. Engle, 592 F.3d 495 (4th Cir., 2010).
In summary, the district court made “an individualized assessment based on the facts presented when imposing a sentence, apply[ing] the relevant § 3553(a) factors to the specific circumstances of the case and the defendant, and . . . state(d) in open court the particular reasons supporting its chosen sentence.” United States v. Lymas, 781 F.3d 106, 111, 113 (4th Cir. 2015) Mr. XXXXX did not adequately overcome the presumption of substantive reasonableness applied to the within- Guidelines sentence, and the record demonstrates no rebuttal by the defense when measured against the sentencing factors. See U.S. v. Louthian, 756 F.3d 295, 306 (4th Cir. 2014) While Mr. XXXXX and his counsel disagree with his sentence, they cannot argue the sentence was not reasonable under applicable Fourth Circuit case law.
Finally, while the Defendant may feel the sentence was unreasonable, he waived his right to appeal the sentence, and undersigned counsel feels compelled to file this brief under Anders v. California, 386 U.S. 738 (1967).
CONCLUSION
In accordance with the requirements of the decision of the United States Supreme Court in Anders v. California, 386 U.S. 738 (1967), appointed counsel for

Mr. XXXXX has reviewed both the facts and legal issues in this case. It is counsel’s opinion that there are no legal issues that were not properly raised or disposed of by the trial court and that there are no grounds for an appeal in this case to the Court of Appeals. DECLARACIÓN DE LA MATERIA Y
JURISDICCIÓN DE LA APELACIÓN
Este caso surge de la prosecución penal del Apelante, junto con múltiples co-acusados en el Tribunal del Distrito de los Estados Unidos para el Distrito de Carolina del Sur, División de XXXXXXX. Al Sr. XXXXXXXXXXXXXXXXX se le acusó con otros co-acusados en un escrito de acusación de solo una alegación, presentado el 15 de septiembre del 2015. (ECF 3) (Nota de la traductora: ECF=Registro Electrónico de Casos) Los imputados fueron acusados de conspiración a poseer con intención de distribuir, y distribución de cocaína, en infracción al título 21, Código de los Estados Unidos, §§ 841(a)(1) y 841(b)(1)(B), todo ello en infracción del título 21, Código de los Estados Unidos, § 846. (ECF 3)
El 19 de enero del 2016, el Sr. XXXXXXX fue acusado de tres alegaciones en un escrito de acusación sustitutivo de ocho alegaciones, con la acusación de conspiración a poseer con intención de distribuir, y distribución de cocaína, en infracción del título 21, Código de los Estados Unidos, §§ 841(a)(1) y 841(b)(1)(C) en infracción del título 21, Código de los Estados Unidos, § 846; posesión con intención de distribuir cocaína en infracción del título 21, Código de los Estados Unidos, §§ 841(a)(1) y 841(b)(1)(C); y, posesión de un arma de fuego llevando a cabo un delito de tráfico de drogas en infracción del título18, Código de los Estados Unidos, § 924(c)(1)(A)(i). El Gobierno solicitó también la confiscación de ciertos bienes. (ECF 87)
El 8 de julio del 2015, el Sr. XXXXX se declaró culpable a la primera alegación (ECF116, 117) del escrito de acusación sustitutivo, conforme a los términos de un convenio de declaración presentada el 23 de marzo del 2016.

(ECF 109) El Sr. XXXXX fue condenado el 23 de agosto del 2016 a 72 meses en prisión, seguidos por un período de libertad vigilada, de 4 años. (ECF 160, 171) El fallo escrito se presentó el 26 de agosto del 2016 (ECF 171) y el Sr. XXXXX presentó oportunamente su notificación de apelación el 1 de septiembre del 2016. (ECF 177)
El Tribunal de Apelaciones tiene jurisdicción sobre este asunto conforme a 28 U.S.C. §§ 1291 y 18 U.S.C. § 3742.
EXPOSICIÓN DE LAS CUESTIONES
Las cuestiones planteadas en esta apelación son, si el Tribunal del Distrito cumplió plenamente con los requisitos de la regla 11 de las Reglas Federales de Procedimiento Penal en la aceptación de la declaración de culpabilidad del acusado, y si su sentencia fue razonable.
EXPOSICIÓN SOBRE EL CASO Y LOS HECHOS
Según la información facilitada a varias agencias federales, el XXXXX fue identificado como participante en una conspiración de tráfico de drogas que adquiría y distribuía cantidades de multi-kilogramos de cocaína en toda el area de los condados de xxxxx, xxxxx, y xxxxx, de Carolina del Sur. (PSR 8) (Nota de la traductora: PSR=Informe Pre-Sentencia)
Durante el invierno del 2014, el FBI y la DEA iniciaron una investigación sobre las actividades de tráfico de drogas de varios individuos en las áreas de los condados xxxxx y xxxxxLee en Carolina del Sur. Como parte de su investigación, los agentes de la DEA y el FBI solicitaron y obtuvieron una orden del tribunal federal que autorizaba la intercepción de comunicaciones telefónicas en teléfonos celulares utilizados por varias personas, incluyendo a XXXXX.

Las pruebas recogidas por medio de estas llamadas interceptadas, revelaron que XXXXX y su hijo, XXXXX le estaban suministrando kilos de cocaina a XXXXX. Basándose en la información derivada de las llamadas telefónicas interceptadas del teléfono de XXXXXX, los agentes de la DEA, y el FBI, solicitaron y obtuvieron una orden del tribunal federal que autorizaba la intercepción de comunicaciones telefónicas en los celulares usados por XXXXX y su proveedor de cocaína, XXXXX. Mediante el uso de comunicaciones interceptadas, vigilancia, la ejecución de órdenes de cateo y otras técnicas de investigación concordantes; los agentes federales aprendieron que XXXXX almacenaba grandes cantidades de cocaína que le suministraba a XXXXX en una instalación de almacenaje de U-Haul, situado en el XXXXXXXXXXX Carolina del Sur. Entre el 2 de enero del 2015 y el 24 de julio del 2015, los agentes federales interceptaron aproximadamente 28 llamadas telefónicas que proporcionaron detalles en cuanto a las actividades de tráfico de drogas de XXXXXXX con XXXXX y .XXXX Durante estas llamadas, XXXXX, XXXXX, y XXXXX hablaban regularmente sobre la adquisición y distribución de multi-kilogramos de cocaína. (PSR 8)
Los agentes federales, entre mayo del 2015 y agosto del 2015, interceptaron llamadas telefónicas y mensajes de texto en los que se detallaban las actividades de narcotráfico entre XXXXX, XXXXX, XXXXX, y el Sr.XXXXX. Específicamente, entre el 12 de julio del 2015 y el 14 de julio del 2015, los agentes federales interceptaron varias llamadas telefónicas y mensajes de texto que establecieron que el Sr. XXXXX facilitó una transacción involucrando dos kilogramos de cocaína que se le suministró a XXXXX. (PSR 8)

El 20 de octubre del 2015, fuerzas policiales ejecutaron una orden federal de arresto para el Sr. XXXXX en XXXXX, Carolina del Sur. Cuando llegaron, los oficiales hablaron con XXXXXXXXXXX en la puerta y notaron que el Sr. XXXXX estaba parado detrás de ella. Le aprehendieron al Sr. XXXXX. Después de que le informaran de sus derechos Miranda, el Sr. XXXXX admitió haber entrado ilegalmente a los Estados Unidos desde México, por la frontera con Arizona y haber viajado a Carolina del Sur en el 2004. El Sr. XXXXX les informó a las fuerzas policiales que había una escopeta en el dormitorio de los niños de XXXXX e indicó que la escopeta, junta con una bolsa de municiones, le pertenecían a otra persona. El Sr. XXXXX también les notificó, que su primo se había quedado previamente en la casa móvil, y que había dejado una cantidad de cocaina en el dormitorio principal. El Sr. XXXXX consintió a una inspección de la casa móvil y de su carro que estaba estacionado afuera. (PSR 9)
Durante la inspección de la casa móvil, las fuerzas policiales encontraron una escopeta Mossberg calibre 12, cargada con cuatro proyectiles, y también dos cartuchos de escopeta en un dormitorio de niños. Encontraron dos básculas digitales, una caja de bolsas plásticas, una bolsa con varios cartuchos de municiones y aproximadamente 33 gramos de cocaína en el dormitorio principal de la casa móvil. (PSR 9)

En octubre del 2015, XXXXX llegó a un acuerdo de cooperación, y le entrevistaron acerca de las actividades de narcotráfico en las zonas de los condados de XXXXX y XXXXX en Carolina del Sur. XXXXX indicó que él obtuvo cocaína del Sr. XXXXX en aproximadamente 10 ocasiones en 2014. XXXXX recibió inicialmente una onza de cocaína, después de dos a tres onzas en otras ocasiones, luego, medio kilo una vez; antes de eventualmente adquirir cantidades de un kilogramo de cocaína del Sr. XXXXX en dos ocasiones. XXXXX le dijo a las autoridades que se reunió con el Sr. XXXXX y su proveedor de cocaína, XXXXX, para negociar un mejor precio en la cocaína. Despues de ese momento, XXXXX comenzó a tratar directamente con XXXXX. (PSR 9)
El 19 de enero del 2016, el Sr. XXXXX fue imputado con tres alegaciones de una acusación formal sustitutiva que contenía ocho alegaciones: la acusación de conspiración a poseer con intención de distribuir y distribución de cocaína, en infracción del título 21del Código de los Estados Unidos, §§ 841(a)(1) y 841(b)(1)(C) en infracción del título 21 del Código de los Estados Unidos, § 846; posesión con intención de distribuir cocaína en infracción del título 21 del Código de los Estados Unidos, §§ 841(a)(1) y 841(b)(1)(C); y, posesión de un arma de fuego llevando a cabo un delito de tráfico de drogas, en infracción del título 18, del Código de los Estados Unidos, § 924(c)(1)(A)(i). El gobierno solicitó también la confiscación de ciertos bienes. (ECF 87)

El 8 de julio del 2015, el Sr. XXXXX se declaró culpable a la primera alegación (ECF 116, 117) de la acusación formal sustitutiva, conforme a los términos de un acuerdo de declaración que fue presentado el 23 de marzo del 2016. (ECF 109)
El Sr. XXXXX fue condenado el 23 de agosto del 2016. (ECF 160) El Informe Investigativo Presentencia indicó (basándose en un grado delictivo ajustado, con total de 27, y en que los antecedentes penales eran de categoría I) que el margen de las directrices resultó ser de 70 a 87 meses. (ECF 189, pág. 4-5, PSR 13)
El Juez X le condenó al Sr. XXXXX a 72 meses en prisión, seguidos por un período de libertad vigilada de 4 años. (ECF 160, 171, 189, pág. 16 - 17) La sentencia escrita se presentó el 26 de agosto del 2016. (ECF 171) El Sr. XXXXX presentó con tiempo su aviso de apelación el 1 de septiembre del 2016. (ECF 177)
El abogado ha revisado el historial de este caso, ha estudiado las cuestiones planteadas por el Sr. XXXXX y comprobó que no tienen mérito. Por tanto, este escrito se presenta en conformidad con Anders v. California, 386 U.S. 738 (1967). Las cuestiones planteadas en esta apelación son, si el tribunal del distrito cumplió con los requisitos Federales R. Penal P. 11 en aceptar la declaración de culpabilidad del Apelante y si su sentencia fue razonable.

RESUMEN DEL ARGUMENTO
EL ARGUMENTO I: Un examen del expediente indica que el tribunal del distrito cumplió plenamente con los requisitos de la regla 11 del las Reglas Federales de Procedimiento Penal cuando el tribunal aceptó la declaración de culpabilidad del acusado. ARGUMENTO II: Una revisión del expediente también indica que la sentencia del tribunal del distrito fue procesalmente y sustancialmente razonable.
NORMA DEL EXAMEN (ARGUMENTO I)
En general, la norma del examen en cuanto a si el tribunal del distrito cumplió adecuadamente con la regla 11 de las Reglas Federales de Procedimiento Penal es de novo. Estados Unidos v. Good, 25 F.3d 218, 219 (4to Cir., 1994). La regla 11 establece que "una variación de los requisitos de esta norma es un error no perjudicial si no afecta a los derechos fundamentales. En la ausencia de un intento por el acusado de retirar una declaración de culpabilidad, las infracciones de la regla 11 se revisan en busca de error evidente. Estados Unidos v. Martínez, 277 F.3d 517 (4to Cir., 2002). Para cumplir con el estándar de error evidente, el Apelante debe demostrar (1) que hubo error; (2) que fue evidente; y que (3) afectó sus derechos fundamentales. Estados Unidos v. Olano, 597 U.S. 725, 732 (1993).
I. ¿EL TRIBUNAL DEL DISTRITO CUMPLIÓ COMPLETAMENTE CON LOS REQUISITOS DE LA REGLA 11 DE LAS REGLAS FEDERALES DE PROCEDIMIENTO PENAL CUANDO ACEPTÓ LA DECLARACIÓN DE CULPABLE DEL ACUSADO?
La regla 11(b)(1) de las Reglas Federales de Procedimiento Penal exige que, antes de aceptar una declaración de culpable, el tribunal debe abordar a cada

acusado personalmente en sesión abierta e informarle al acusado de lo siguiente, y determinar que el acusado entienda lo siguiente:
(A) el derecho del gobierno, en un enjuiciamiento por perjurio o falso testimonio, de usar en contra del acusado cualquier declaración que el acusado dé, bajo juramento;
(B) el derecho de declararse no culpable, o del ya haberse declarado así, a persistir en esa declaración.
(C) el derecho a un juicio con jurado.
(D) el derecho a que le represente un abogado y, si fuera necesario, que el tribunal le nombre un abogado en el juicio y en todas las fases del procedimiento;
(E) el derecho en el juicio a confrontar y a contrainterrogar a los testigos en su contra, a ser protegido de la autoinculpación obligatoria, a declarar y a presentar pruebas y a obligar la comparecencia de testigos;
(F) la renuncia, por el acusado, a estos derechos de juicio si el tribunal acepta una declaración de culpable o nolo contendere;
(G) el carácter de cada una de las alegaciones a las cuales el acusado se está declarando;
(H) cualquier pena máxima posible, incluyendo la pena de prisión, multa y período de libertad supervisada;
(I) cualquier sanción mínima obligatoria;
(J) cualquier decomiso aplicable;
(K) la autoridad del tribunal a ordenar restitución;

(L) la obligación del tribunal a imponer una tarifa especial;
(M) la obligación del tribunal de aplicar las directrices de imposición de condenas y la discreción del tribunal de apartarse de dichas directrices en algunas circunstancias; y
(N) los términos de la disposición en el convenio de declaración, renunciando el derecho a apelar o a colateralmente atacar la sentencia,
(O) que, de ser hallado culpable, un acusado que no sea ciudadano de los Estados Unidos, podrá ser expulsado de los Estados Unidos, se le puede negar la ciudadanía, y se le puede negar la entrada a los Estados Unidos en el futuro.
La regla 11(b)(2) requiere que el tribunal determine que la declaración es voluntaria, y que "no resultó de coacción, amenazas o promesas aparte de lo hecho en el acuerdo de declaración".
La regla 11(b)(3) requiere que el tribunal determine la existencia de un fundamento fáctico para la declaración antes de emitir sentencia.
La regla 11(c)(2), le exige a las partes a revelar el convenio de declaración en sesión abierta cuando se ofrezca el acuerdo; a menos que el tribunal por motivo justificado, le permita a las partes a revelar el convenio de declaración en cámara.
La regla 11(c)(3)(B) requiere que, en la medida en que el acuerdo negociado del acusado es del tipo especificado en la regla 11(c)(1)(B), el tribunal tiene que aconsejarle al acusado de que no tiene el derecho de retirar la declaración si el tribunal no acepta la recomendación o solicitud.

Durante el procedimiento Regla 11 en este caso, el tribunal tomó el juramento del Sr. XXXXX, y le informó que cualquier declaración que diera bajo juramento se podría utilizar en su contra, como requiere la regla 11. (ECF 191, pág. 4)
El Tribunal le informó al Sr. XXXXX de su derecho a declararse no culpable, su derecho a un juicio por jurado, y su derecho a que le represente un abogado. (ECF 191, pág. 21-22)
Asimismo, el tribunal le informó al Sr. XXXXX de sus derechos asociados con tener un juicio, tales como el derecho a confrontar y contrainterrogar a los testigos en su contra, a declarar y presentar pruebas, y a obligar la comparecencia de testigos. (ECF 191, pág. 21-22)
El tribunal se aseguró que el Sr. XXXXX entendía que estaría renunciando sus derechos a un juicio por jurado y a todos los derechos asociados con un juicio por jurado, si el tribunal aceptara su declaración de culpabilidad. (ECF 191, pág. 21-22)
El tribunal le informó al Sr. XXXXX del caracter de las acusaciones a las que él se declaraba culpable. (ECF 191, pág. 8, 9, 22-24) El tribunal le informó al Sr. XXXXX de la posible pena máxima de prisión, multa y libertad vigilada. (ECF 191, pág. 24-25) Además, el tribunal le informó al Sr. XXXXX que la corte tiene la obligación de aplicar las directrices de imposición de condenas, y la discreción del tribunal de apartarse de las directrices en algunas circunstancias. (ECF 191, pág. 17-20)
La declaración del Sr. XXXXX se resumió en sesión abierta. (ECF 191, pág. 9-12)

El Tribunal repasó las penas máximas para los delitos a los que el Sr. XXXXX se declaró, incluyendo, la tarifa especial, y la condena obligatoria mínima en este caso. (ECF 191, pág. 24-26)
El juez del tribunal del distrito repasó la disposición de renuncia a la apelación con el Sr. XXXXX. (ECF 191, pág. 11, 13-14)
El juez del tribunal del distrito examinó y se aseguró que el Sr. XXXXX sabía y entendía las disposiciones en el convenio de declaración sobre el decomiso. (ECF 191, págs. 11, 13).
La restitución no estaba en cuestión, por lo que el tribunal no le avisó el Sr. XXXXX de su autoridad para ordenar restitución en conformidad con la regla 11(b)(1)(K). (PSR 15)
El Tribunal le comunicó al Sr. XXXXXX que potencialmente podría ser expulsado de los Estados Unidos, y que su declaración de culpable podría resultar en consecuencias migratorias negativas en el futuro en conformidad con la regla 11(b)(1)(O). (ECF 191, pág. 15)
Antes de emitir sentencia, el tribunal determinó que existía un fundamento fáctico para la declaración. (ECF 191, pág. 26-32)
El tribunal determinó que la declaración de culpable del Sr. XXXXX fue a sabiendas y voluntariamente, con inteligencia y con pleno conocimiento de todas las consecuencias que podrían derivarse de la declaración, y no el resultado de coacción, amenazas o promesas; aparte de las promesas contenidas en su convenio de declaración. (ECF 191, pág. 11, 13, 15, 21- 26)

La regla 11(c)(3)(B) requiere que, si el convenio negociado del acusado es del tipo especificado en la regla 11(c)(1)(B), el tribunal tiene que aconsejarle al acusado de que no tiene el derecho de retirar la declaración si el tribunal no acepta la recomendación o solicitud. El convenio de declaración no contenía disposiciones establecidas en el artículo 11(c)(1)(B).
Por tanto, aparentemente, el tribunal del distrito cumplió plenamente con la regla 11 cuando aceptó la declaración de culpable del Sr. XXXXX.
NORMA DE EXAMEN (ARGUMENTO II)
El Tribunal estudia una sentencia en cuanto a su caracter de razonable, concentrándose en si el tribunal del distrito abusó de su discreción. Gall v. los Estados Unidos, 128 S. Ct. 586, 597 (2007), Estados Unidos v. Pauley, 511 F.3d 468, 473 (4to Cir., 2008).
II. ¿FUE RAZONABLE LA SENTENCIA DEL TRIBUNAL DEL DISTRITO?
"Al emitir sentencia contra un acusado, una corte de distrito debe: (1) Calcular correctamente la escala de las directrices (2) determinar si una sentencia dentro de esa escala sirve a los factores establecidos en 18 U.S.C. §3553(a); (3) aplicar la prescripción obligatoria por estatuto y, (4) explicar las razones por las cuales seleccionó esa sentencia." Estados Unidos v. Green, 436 F.3d 449 (4to Cir.), cert. denegado, 126 S. Ct. 2309 (2006).
El juez de la corte del distrito empezó la audiencia asegurándose de que el Sr. XXXXX y su abogado habían revisado el Informe Investigativo Presentencia. (ECF 189 pág. 2-3) El abogado del Sr. XXXXX retiró su protesta a la ampliación de la acusación con respecto al arma de fuego contenido en el informe presentencia.

El Juez X se aseguró que el Sr. XXXXX estaba de acuerdo con que su abogado había retirado sus protestas. (ECF 189, p. 3-4)
Después de aceptar las conclusiones legales y fácticas en el Informe Investigativo Presentencia sin protesta, el juez de la corte del distrito calculó el nivel aplicable de las directrices de sentencia. (ECF 189, pág. 4) Cuando se determinaba las cantidades de droga atribuible, para el propósito de las directrices de sentencia, se le responsabilizó al Sr. XXXXX por la cantidad de cocaína que se obtuvo a través de las comunicaciones interceptadas, la cantidad de cocaína decomisada de su residencia en octubre del 2015, y las cantidades atribuídas a él durante la entrevista ofrecida por XXXXX, cual llegó a un total de 4.673 kilogramos de cocaína. (PSR 9) El oficial de libertad vigilada, calculó un nivel base de 28, le añadió 2 puntos por la posesión de un arma de fuego, y le restó 3 puntos por aceptar responsabilidad. (PSR 11) La puntuación en cuanto a los antecedentes penales del Sr. XXXXX se calculó correctamente, usando los cálculos apropiados del Capítulo 4 de las directrices de sentencia de los EEUU, y el resultado de los antecedentes penales fué una categoría I. (PSR 10-11) El Informe Investigativo de Presentencia indicó (basándose en un grado delictivo ajustado de 27 y los antecedentes penales, categoría I) que la escala de las directrices era de 70 - 87 meses. (ECF 189, pág. 4-5, PSR 13) Cuando se revisa una sentencia, esta corte debe primero determinar si la sentencia, desde el punto de vista de procedimiento, fue razonable. Por ejemplo, que no hay errores en el cálculo de las directrices; porque las directrices consultivas de condenas se calcularon correctamente.

Aparentemente, la sentencia, desde el punto de vista de procedimiento, fue razonable. Estados Unidos v. McGee, 736 F.3d 263, 271 (4to Cir. 2013).
El abogado del Sr. XXXXXX entonces pidió oralmente una variación descendente. El licenciado le notificó al tribunal que el Sr. XXXXX había sido un empleado de construcción durante la primavera del 2015 con un problema grave de adicción a la cocaína. El licenciado alegó que el Sr. XXXXX usaba grandes cantidades de cocaína pero que no recibía remuneración por ella, ni tampoco mantenía a su familia con fondos adquiridos de las ventas de cocaína. El licenciado reconoció que el Sr. XXXXX tenía 33 gramos de cocaina en su residencia cuando la revisaron, pero que la cocaína era principalmente para su consumo personal. El licenciado también señaló que al Sr. XXXXX no se le pagó por las transacciones entre otras partes. El licenciado dijo que la escopeta, tambien descubierta durante la revisión de la casa del Sr. XXXXX, era de otra persona. (ECF 189, pág. 5-8)
El licenciado para el gobierno respondió que los hechos alegados por el licenciado del Sr. XXXXX eran inconsistentes con los hechos que aparecían en los párrafos 20 y 21 en el PSR, a los cuales no hubo protesta. (ECF 189, pág. 5-8) El licenciado para el gobierno también señaló que, aunque el Sr. XXXXX puede haber sido un usuario de gran cantidad de drogas; solo se le responsabilizó por las drogas que distribuyó o gestionó en realidad. No se le imputó responsabilidad por una cantidad considerable, por las cuales se le pudo haber imputado responsabilidad.

Por tanto, los factores 18 U.S.C. § 3553, no apoyaban una sentencia de variación descendente. (ECF 189, 9 - 12)
El Juez X le negó la moción del acusado para una variación descendente basado en el hecho de que el Sr. X, en realidad, participó personalmente o manipuló la cantidad de drogas por las cuales se le imputó responsabilidad. El Juez X luego revisó a fondo los factores de sentencia aplicables listados bajo 18 U.S.C. § 3553, y le condenó al Sr. XXXXX a 72 meses en prision, seguidos por 4 años de libertad vigilada. (ECF 160, 171, 189, pág. 12 - 16) El fallo por escrito se presentó el 26 de agosto del 2016. (ECF 171)
El juez abordó de forma adecuada el 18 U.S.C.A. § 3553. "Bajo Gall, primero tenemos que “asegurar que la corte del distrito no cometió ningún error en cuanto a procedimiento." Estados Unidos v. Seay, 553 F.3d 732 (4to Cir., 2009). "Una sentencia puede ser desde el punto de vista de procedimiento irrazonable, por ejemplo, si la corte del distrito no proporciona una declaración de motivos adecuados o no establece las afirmaciones fácticas necesarias." Estados Unidos v. Moreland, 437 F.3d 424 (4to Cir. 2006).
La recitación del juez, que él había considerado los factores 3553 (a) fue una declaración adecuada de motivo. (ECF 189, pág. 16) El Juez X revisó a fondo los factores 3553 que se aplicaban al Sr. XXXXX. (ECF 189, pág. 12 – 16)
"A los tribunales que dictan sentencia se les requiere por estatuto que declaren sus motivos por imponer la condena." Véase 18 U.S.C.A. § 3553(c) (West Supp. 2009). Aunque no se requiera necesariamente una opinion integralmente detallada, la explicación que da el tribunal, no obstante, tiene que ser lo suficiente 'para satisfacer el tribunal de apelaciones que [la corte del distrito] ha considerado las alegaciones de las

partes, y que tiene una base bien fundada para ejercitar [su] propia autoridad de tomar decisiones legales.' Rita v. Estados Unidos, 551 U.S. 338, 356, 127 S.Ct. 2456, 168 L.Ed.2d 203 (2007)”
Estados Unidos v. Engle, 592 F.3d 495 (4to Cir., 2010).
En resumen, la corte del distrito hizo "una evaluación individual basada en los hechos presentados cuando impuso sentencia, aplic(ando) los factores relevantes de § 3553(a) a las circunstancias específicas del caso y el acusado, y … declaró en sesión abierta las razones en particular que apoyaban su condena elegida. Estados Unidos v. Lymas, 781 F.3d 106, 111, 113 (4to Cir. 2015) El Sr. XXXXX no superó adecuadamente la presunción de razonabilidad sustantiva que se le aplica a una sentencia que está dentro de las directrices, y las actas reflejan que no hubo refutación por la defensa cuando se mide en contra de los factores de sentencia. Véase EEUU v. Louthian, 756 F.3d 295, 306 (4to. Cir. 2014) A pesar de que el Sr. XXXXX y su abogado no están de acuerdo con su sentencia, no pueden alegar que la sentencia no fue razonable bajo la jurisprudencia aplicable del Cuarto Circuito.
Finalmente, a pesar de que el acusado sienta que su sentencia sea irrazonable, él renunció su derecho a apelar la sentencia, y el abajofirmante licenciado se siente obligado a presentar este escrito bajo Anders v. California, 386 U.S. 738 (1967).

CONCLUSIÓN
En conformidad con los requisitos de la decisión de la Corte Suprema de los EEUU en Anders v. California, 386 U.S. 738 (1967), el abogado nombrado para
representar al Sr. XXXXX ha revisado ambos, los hechos y las cuestiones legales en este caso. Es la opinión del abogado, que no existen cuestiones legales que no fueran debidamente planteadas o dispuestas por el tribunal, y que no existen motivos para una apelación en este caso al Tribunal de Apelaciones.
