ROZPORZĄDZENIE MINISTRA INFRASTRUKTURY
z dnia 6 lutego 2008 r.
w sprawie przepisów ruchu lotniczego
Na podstawie art. 121 ust. 6 pkt 1 ustawy z dnia 3 lipca 2002 r. - Prawo lotnicze (Dz. U. z 2006 r. Nr 100, poz. 696, z późn. zm.) zarządza się, co następuje:
§ 1. Przepisy ruchu lotniczego określają normy zawarte w Załączniku 2 do Konwencji o międzynarodowym lotnictwie cywilnym, podpisanej w Chicago dnia 7 grudnia 1944 r. (Dz. U. z 1959 r. Nr 35, poz. 212 i 214, z późn. zm.).
§ 2. Kompetencje i obowiązki "właściwej władzy ATS", o której mowa w Załączniku 2 do Konwencji o
międzynarodowym lotnictwie cywilnym, wykonuje instytucja zapewniająca służby ruchu lotniczego
wyznaczona na podstawie odrębnych przepisów.
§ 3. 1. Prezes Urzędu Lotnictwa Cywilnego zawiadamia Organizację Międzynarodowego Lotnictwa
Cywilnego o różnicach w rozumieniu art. 38 Konwencji o międzynarodowym lotnictwie cywilnym.
2. Różnice, o których mowa w ust. 1, są ogłaszane w Dzienniku Urzędowym Urzędu Lotnictwa Cywilnego oraz w Zintegrowanym Pakiecie Informacji Lotniczych, w Zbiorze Informacji Lotniczych Polska (AIP Polska).
§ 4. Dokumenty (Doc) opublikowane przez Organizację Międzynarodowego Lotnictwa Cywilnego
(ICAO), o których mowa w Załączniku 2 do Konwencji o międzynarodowym lotnictwie cywilnym, stosuje
się od dnia wejścia w życie rozporządzenia, wydanego na podstawie art. 3 ust. 4 ustawy z dnia 3 lipca
2002 r. - Prawo lotnicze, wprowadzającego do stosowania dokument, do którego odwołuje się Załącznik 2
do Konwencji o międzynarodowym lotnictwie cywilnym.
§ 5. Rozporządzenie wchodzi w życie po upływie 14 dni od dnia ogłoszenia.

REGULATION OF THE MINISTER OF INFRASTRUCTURE
of 6 February 2008
on air traffic rules
On the basis of article 121 section 6 item 1 of the Act of 3 July 2002 – Aviation Law (Polish Journal of Laws of 2006 No. 100, item 696, with subsequent amendments) it shall be ordered as follows:
§ 1. The air traffic rules are defined by the standards as included in Appendix No. 2 to the Convention on International Civil Aviation that was signed in Chicago on the day of 7 December 1944 (Polish Journal of Laws of 1959 No. 35 items 212 and 214, with subsequent amendments.).
§ 2. The institution that ensures air traffic services, which can be determined on the basis of separate rules, fulfils the competences and obligations of the “ATS proper authority” that is referred to in Appendix No. 2 to the Convention on International Civil Aviation.
§ 3. 1. The President of the Civil Aviation Office informs the International Civil Aviation Organization about the differences within the meaning of article 38 of the Convention on International Civil Aviation.
2. The differences that are referred to in item 1 are published in the Journal of Laws of the Civil Aviation Organization and in the Integrated Aeronautical Information Package at the Aeronautical Information Publication Poland (AIP Poland).
§ 4. The documents (Doc) that are published by the International Civil Aviation Organization (ICAO) that are referred to in Appendix No. 2 to the Convention on International Civil Aviation, shall be applied as from the day when the regulation issued on the basis of article 3 section 4 of the Act of 3 July 2002 – Aviation Law, which introduces the PlayStation of the document that is referred to in Appendix No. 2 to the Convention on International Civil Aviation, enters into force.
§ 5. The regulation enters into force after 14 days as from the day of its publication.
