I am a Fee Earner/File Handler with the Practice. Arshad Mahmood is the Principal of the Practice who will have overall responsibility for the matter and the supervision of my work. We may be assisted by other members of staff as the matter progresses.
We confirm that we are prepared to act for you under a Conditional Fee Agreement. Under this you will not be liable for our fees unless and until your claim succeeds, and any expenses which we may incur in bringing your claim will be deferred until the conclusion of the matter, when most expenses can be recovered from the other side by a successful complainant. We will let you know when that is not the case.
We enclose for your attention:-
1) Conditional Fee Agreement;
2) Funding Checks Form (to assess whether you may have any legal expenses cover);
3) Your authority to obtain medical records;
We would be grateful if you could kindly fully complete, sign and return the same to our offices so that we may progress your claim. A signed copy of the retainer is enclosed for your retention.
Preliminary Advice
We would confirm our initial advice to you that we will pursue your personal injury claim against the third party.
We have enclosed for your information General Guidance on how claims of this nature usually progress.
We would anticipate that completion of instructions will take between 8 and 14 months, although you will appreciate that this is dependent upon a number of factors which are ultimately beyond our control.
We would anticipate that the matter will take between 12 and 18 months where the matter settles without the need to issue proceedings. Where proceedings are issued and may go to trial, this will take between 18 and 24 months depending upon whether it actually goes to trial or is settled before then. We will advise you further as the matter proceeds.
Please ensure that you do not discuss any details of your claim with the third party insurer or any other person. If you are sent any correspondence or receive any telephone calls, simply advise them to contact your solicitor, and pass them onto us. Once we are instructed, you should not contact the other side or their insurers, as it could severely prejudice your case
It is vital that we can contact you at all times until your case is settled. Please inform us in writing of any change of address or telephone number, as failure to do so could delay and prejudice your claim. Please also tell us at once of any other Court proceedings you are aware of and forward copies of any documents you may have received straight away. We cannot deal with any other person without your written permission in advance. Once you have told us something, should changes occur, please inform us in writing.
Mitigation of loss
May I also take this opportunity to remind you of your duty to mitigate any loss that has occurred as a result of this accident. This is something the courts say you must do. If for example you have been provided with a replacement Vehicle or Hire Car under a Credit Agreement, you must ensure this is done as a last resort and you have no other alternative. The reason for this is because ultimately you will be claiming these expenses from the other side and they will question why they should pay, whether you could have mitigated your loss i.e. repaired your vehicle or purchased a new vehicle rather than build up hire costs which might be more expensive than the damage to your vehicle.
Furtherance of Your Instructions
Your present instructions are for us to pursue a claim on your behalf for personal injury, vehicle damage, hire and storage and recovery charges. If you wish to add anything to your claim you must inform us without delay.
We will be shortly be instructing an engineer to inspect your vehicle/arrange for you to be seen by a medical expert who will assess your injuries.
In the meantime we will be obliged if you could return the signed conditional fee agreement together with your identification documentation
Third Party Authorities/ Commission
Kindly note, we are not permitted to pay your damages to any third party (or forward any cheque made out to you to them), even where you have given us written authority to do so, unless they operate a designated client account (certified by an independent accountant) and have given us an undertaking that the money will be paid to you in full without delay, and indemnify us in respect of any losses, damages, costs, awards, penalties or fines where they fail to do so, including the costs and expenses of any proceedings in connection therewith.
If you have any concerns at any time do raise them with me. If I am not able to resolve these, you are free to contact the Compliance Officer for Legal Practice at these offices. Our client care procedures are referenced at the end of the enclosed retainer, including the Legal Ombudsman Service.
