Source text - Romanian (1) Capacitatea economică şi financiară a ofertantului poate fi susţinută, pentru îndeplinirea unui contract, şi de o altă persoană, indiferent de natura relaţiilor juridice existente între ofertant şi persoana respectivă.
(2) În cazul în care ofertantul îşi demonstrează situaţia economică şi financiară invocând şi susţinerea acordată, în conformitate cu prevederile alin. (1), de către o altă persoană, atunci acesta are obligaţia de a dovedi susţinerea de care beneficiază, de regulă prin prezentarea unui angajament ferm al persoanei respective, prin care aceasta confirmă faptul că va pune la dispoziţie ofertantului resursele financiare invocate. Persoana ce asigură susţinerea financiară nu trebuie să se afle în situaţia care determină excluderea din procedura de atribuire conform prevederilor prezentate la capitolul II.1 – Situatia personala a ofertantului.
(3) Atunci când un grup de ofertanti depun oferta comună, situaţia economică şi financiară se demonstrează prin luarea în considerare a resurselor tuturor membrilor grupului. În cazul în care grupul beneficiază de susţinerea financiară a unei/unor terţe persoane, situaţia economică şi financiară se demonstrează în condiţiile prevăzute la alin. (2).
Translation - English (1) The economic and financial capacity of the tenderer may be supported, for the performance of a contract, by a third person, regardless of the nature of legal links between the tenderer and that person.
(2) If the tenderer proves his economic and financial standing by relying on the support of a third person, in accordance with the provisions of paragraph (1), then he is required to prove that support, generally by submitting an undertaking to the effect that the person in question confirms that it will place at the tenderer’s disposal the financial ressources claimed. The person offering the financial support must not be in any of the situations which lead to the exclusion from the procedure for the award, in accordance with Chapter II. 1 – Personal situation of tenderer.
(3) If a group of tenderers submit a joint offer, the economic and financial standing shall be proven by considering the ressources of all members of the group. In case such a group benefits from the financial support of a third person or persons, the economic and financial standing shall be proven in the conditions laid down in paragraph (2).

Source text - Romanian Adepţii acestei fundamentări reduc impreviziunea contractuală la abuzul de drept. Se consideră că este un abuz de drept să ceri executarea unui contract fără să se ţină cont de intenţia părţilor şi limita voinţei reciproce de a contracta, aşa cum este abuz de drept să se aplice legile cu excluderea practicii juridice obişnuite. Împotriva acestei teorii s-a susţinut că în situaţia în care creditorul cere debitorului să-şi execute obligaţia asumată prin contractul valabil încheiat nu se comite un abuz de drept deoarece convenţiile au putere de lege între părţi şi trebuie executate aşa cum părţile au convenit . f) Teoria forţei majore Împrejurările care determină dezechilibrul grav între prestaţii sunt obiective, imprevizibile, inevitabile şi se situează în afara voinţei părţilor astfel că pot fi considerate cazuri de forţă majoră. Cauza de forţă majoră poate conduce la încetarea contractului pentru imposibilitatea executării obligaţiilor uneia dintre părţi. Însă, forţa majoră are ca efect imposibilitatea absolută de executare a contractului. Fluctuaţiile de preţuri îi pot crea debitorului dificultăţi în executarea contractului, dar nu sunt şi cauze de împiedicare absolută a acestuia de a-şi executa obligaţia, astfel că ele nu intră în câmpul forţei majore.
Translation - French Les adeptes de cette théorie réduisent l’imprévision contractuelle à l’abus de droit. On considère que l’exigence d’exécuter un contrat sans tenir compte de l’intention des parties et de la limite de la volonté réciproque de contracter est un abus de droit. De la même manière, l’application des lois à l’exclusion de la pratique juridique habituelle est un abus de loi.
L’argument contre cette théorie réside dans le fait que, lorsque le créancier demande au débiteur de respecter l’obligation qui lui incombe en vertu du contrat valable conclu, il ne commet pas un abus de droit parce que les conventions ont force de loi pour les parties et doivent être exécutées telles qu’elles sont convenues. . f) La théorie de la force majeure
Les circonstances qui déterminent un déséquilibre grave entre les prestations sont objectives, imprévisibles, inévitables et indépendantes de la volonté des parties, de telle manière qu’elles peuvent être considérées comme des cas de force majeure. Corrective maintenance activities
The activities comprise:
Complete replacement of damaged or unused equipments or parts of them;
Equipment’s operative functions reconfiguration and restore;
Logistic management for the replacement parts
Temporary replacement of the damaged equipment with an equivalent one.
Translation - Romanian Prin servicii corective de întreţinere la faţa locului se înţeleg diagnosticul şi eliminarea cauzei defecţiunii. Această activitate este cauzată de imposibilitatea de a utiliza aplicaţia/funcţia sau de diferenţele de utilizare comparativ cu acţiunea aşteptată. Serviciul corectiv de întreţinere are drept scop rezolvarea defecţiunilor la faţa locului prin diagnosticarea şi îndepărtarea cauzelor şi efectelor.
