3. Peuple et souveraineté
La question de la constitution européenne n’est pas la même que celle de la rupture avec l'ordre néo-libéral et que celle des droits naturels, économiques et sociaux. Elle comprend la question de la démocratie dans un sens réel et très concret d'un espace public où les peuples prennent en charge leur destin commun. Cette question de la démocratie se pose en deux temps :
- Il y a tout d’abord la question du souverain : de qui procède le pouvoir politique, d’où tire-t-il sa légitimité ?
- Il y a ensuite la question de la forme institutionnelle : quelle forme choisit-on de donner aux principes démocratiques ?
Qui est souverain ?
Définir le souverain au sein d'une entité politique, c'est définir quelle est la source légitime du pouvoir. Cette question est le fondement de toutes les autres puisque la réponse qu'on lui donne définit, entre autres choses, la nature de toute entité européenne, l'équilibre entre celle-ci et les États, le contenu des institutions représentatives (32). Alors que ce mot de souverain est courant en Suisse où il désigne très naturellement le peuple, il sonne vieux jeu en France et évoque plutôt les souverainistes. Mais ce mot fait en fait référence à une époque où dans son cadre géographique et politique d'alors, le peuple était la source légitime du pouvoir. Les constitutions française, allemande ou suisse, entre autres, écrivent ainsi que "le peuple français proclame" et que le principe de la République est "le gouvernement du peuple, par le peuple, pour le peuple" (art. 2), que "le peuple allemand s'est donné la présente constitution" (préambule) et que "tout pouvoir émane du peuple" (art. 20-2), ou que "le peuple et les cantons suisses [...] arrêtent la constitution que voici" (préambule).

3. Popolo e sovranità
La questione della costituzione europea non è la stessa di quella della rottura con l’ordine neo-liberale né quella dei diritti naturali, economici e sociali. Questa questione è il fondamento di tutte le altre perché la risposta che gli si da’ definisce, tra le altre cose, la natura di tutte le entità europee, l’equilibrio tra queste e gli Stati, il contenuto delle istituzioni di rappresentanza (32). Allorquando in Svizzera il la parola sovrano è usuale e designa in modo naturale il popolo, suona invece attempato in Francia, dove evoca piuttosto i souverainistes. Questa parola, di fatto, fa’ riferimento a un’epoca in cui, nel suo contesto geografico e politico d’allora, il popolo era la fonte legittima del potere. Le costituzioni francese, tedesca e svizzera, tra le altre, scrivono che: “ il popolo francese proclama” e che il principio della Repubblica è “il governo del popolo, per mezzo del popolo, per il popolo” (art. 2), che “il popolo tedesco si è dato la presente costituzione” (preambolo) e che “ogni potere emana dal popolo” (art. 20-2), o che “i popoli e i cantoni svizzeri [...] si sono dati la presente Costituzione” (preambolo).
