1. Swobodny przepływ towarów
Choć początkowo Polska nie zgłaszała żadnych zastrzeżeń co do treści acquis w tym obszarze, 28 listopada 2001 r. dokonała ponownego otwarcia obszaru i wystąpiła o przyznanie okresu przejściowego jeśli chodzi o wprowadzenie wspólnotowej procedury rejestracji leków do 31 grudnia 2008. Decyzję uzasadniono znacznymi wydatkami budżetowymi, jakie Polska i polscy przedsiębiorcy będą musieli ponieść w związku z wdrożeniem dorobku prawnego Unii w tym zakresie.
2. Swobodny przepływ osób
Polska zdecydowała się przyjąć w całości dorobek Wspólnoty w tym obszarze. Obawy i zastrzeżenia dotyczące tego obszaru zgłoszone zostały przez stronę unijną i wynikały przede wszystkim z obaw o destabilizację wewnętrznego rynku pracy Unii wskutek przepływu siły roboczej. Ostatecznie zdecydowano się na okresy przejściowe w formule 2+3+2, czyli ograniczeń w dostępie do unijnego rynku pracy przez pierwsze dwa lata członkostwa, z możliwością przedłużenia o dodatkowe 3 i w razie potrzeby o kolejne 2 lata w razie stwierdzenia znacznego stopnia destabilizacji rynków pracy w państwach członkowskich. Jednostronne deklaracje o gotowości do otwarcia rynku pracy dla polskich pracowników od pierwszego dnia członkostwa zgłosiły Szwecja, Dania, Irlandia, Grecja, Wielka Brytania. Włochy i Francja zliberalizują rynek po 2 latach, dłuższy okres przejściowy najprawdopodobniej zastosują Niemcy i Austria.
3. Swoboda świadczenia usług
Polska zdecydowała się przyjąć całość acquis za wyjątkiem trzech okresów przejściowych dotyczących: wdrożenia wspólnotowych zasad regulujących kwestie minimalnego poziomu funduszy własnych takich instytucji, jak banki spółdzielcze i instytucje kredytowe. Po drugie, ustalono pięcioletni okres przejściowy (do 31 grudnia 2007 r.) na wdrożenie regulacji dotyczących ochrony inwestorów na rynku kapitałowym. Po trzecie, derogowano spod działania tzw. Pierwszej Dyrektywy Bankowej: Spółdzielcze Kasy Oszczędnościowo Kredytowe (SKOK), Bank Gospodarstwa Krajowego (BGK) oraz Korporację Ubezpieczeń Kredytów Eksportowych (KUKE).
4. Swobodny przepływ kapitału.
Jest to obszar negocjacyjny, który, obok kwestii związanych z rolnictwem, okazał się jednym z najtrudniejszych w negocjacjach, zwłaszcza przepisy dotyczące nabywania nieruchomości przez cudzoziemców. Polscy negocjatorzy wskazywali na obawy przed gwałtownym wzrostem cen nieruchomości oraz zagrożenie spekulacją nieruchomościami w związku z przewidywanym wzrostem cen. Dodatkowo, wskazywano na emocjonalne i historyczne zabarwienie debaty w Polsce wokół wyprzedaży ziemi cudzoziemcom.
Ostatecznie Polska otrzymała zgodę na dwa okresy przejściowe: pięcioletni okres ochrony polskiego rynku nieruchomości przed nabywaniem tzw. drugich domów przez cudzoziemców oraz dwunastoletni okres możliwości stosowania polskich regulacji prawnych w kwestii nabywania ziemi rolnej i obszarów leśnych.
6. Polityka konkurencji.
W toku negocjacji strona polska postulowała utrzymanie dotychczasowych reguł funkcjonowania specjalnych stref ekonomicznych (SSE) w stosunku do przedsiębiorstw, które działalność w tych strefach rozpoczęły przed 1 stycznia 2001. Ostatecznie uzgodniono, że dotychczasowe zasady funkcjonowania SSE zostaną zachowane do 2011 r. dla małych i do 2010 r. dla średnich przedsiębiorstw. Dodatkowo, zdecydowano o zwiększonym pułapie pomocy publicznej związanej z inwestycjami na ochronę środowisk w zakresie zasad uzgodnionych w obszarze 22 (Środowisko) oraz ustalono zasady restrukturyzacji hutnictwa, zakładające redukcję mocy i zatrudnienia w polskich hutach i osiągnięcie rentowności sektora do 2006 roku.
7. Rolnictwo.
Mając na względzie wielkość polskiego sektora rolniczego i warunków jego funkcjonowania, negocjacje w tym obszarze można zaliczyć do zdecydowanie najtrudniejszych, budzących najwięcej kontrowersji i emocji, a z drugiej strony do posiadających kluczowe znaczenie. Stanowisko negocjacyjne w tym obszarze jest najobszerniejsze i zawiera aż 465 stronicową dokumentację . Od początku negocjacji do najtrudniejszych kwestii należała wysokość i długość okresu dochodzenia do pełnego poziomu dopłat bezpośrednich oraz objęcia polskiego rolnictwa pozostałym instrumentarium Wspólnej Polityki Rolnej (WPR). 13 grudnia 2002 w Kopenhadze zdecydowano o przyznaniu Polsce dopłat w wysokości średnio 60% wsparcia udzielanego rolnikom unijnym w latach 2004-2006 (55% w roku 2004, 60% w roku 2005 i 65% w roku 2006) przy poziomie dopłat z budżetu funduszy strukturalnych WPR w wysokości maksymalnie 20% tych środków, lub odpowiednio: 25%, 20% i 15%. Pozostała część dopłat ma być finansowana z budżetu państwa. Od 2007 r. Polska będzie dążyć do wyrównania poziom dopłat bezpośrednich zwiększając je o 30% ponad poziom dopłat dla danego roku. W Kopenhadze wystąpiono także o przesunięcie części środków z puli przeznaczonej na rozwój wsi i obszarów wiejskich, na dopłaty bezpośrednie. Unia wyraziła zgodę na realokację na ten cel maksimum 20% środków przewidzianych w ujęciu rocznym w okresie od 2004 do 2006 r. lub 25% w 2004 r., 20% w 2005 r. i 15% w 2006 roku. Wiele miejsca w negocjacjach poświęcono także wsparciu unijnemu gospodarstw niskotowarowych. Pod naciskiem strony polskiej podwyższono wsparcie do poziomu 1250 EURO rocznie na gospodarstwo, co jest znaczną zmianą w stosunku do proponowanych pierwotnie 750 EURO.
8. Rybołówstwo.
Obszar podzielony jest na cztery zasadnicze grupy problemów dotyczące: zarządzania i kontroli zasobów, organizacji wspólnego rynku, pomocy państwa i polityki strukturalnej oraz międzynarodowych umów rybackich. W zamian za udostępnienie łowisk na obszarze zachodniego Bałtyku, i dalekomorskich łowisk UE, Polska zdecydowała się „wpuścić” kutry unijne na polskie łowiska z wyłączeniem pasa wód terytorialnych. W ramach kwot przyznanych przez UE, Polska zachowa jednocześnie prawo do połowów w dotychczasowych wielkościach. Odmiennie niż w przypadku negocjacji w obszarze „Rolnictwo”, mniejszy nacisk położono na przydzielone kwoty i limity, a więcej kontrowersji wzbudził stopień przystosowania technicznego polskiego sektora rybackiego do regulacji unijnych.
9. Polityka transportowa.
Kwestie, które dla strony polskiej posiadały kluczowe znaczenie, zmieniały się wraz z modernizacją i restrukturyzacją największych polskich przewoźników: PLL LOT, PKP oraz PKS. Najważniejsze problemy ogniskowały się wokół trzech podstawowych kwestii:
Dopuszczenie przez obecne państwa Unii przewoźników z nowych państw członkowskich do wykonywania tzw. przewozów kabotażowych (krajowego transportu rzeczy) na terytorium tych pierwszych. Strony zdecydowały się na zastosowanie trzyletniego okresu przejściowego z możliwością jednorazowego jego przedłużenia o kolejne dwa lata, kiedy to firmy mające siedzibę w Polsce nie będą mogły wykonywać takich przewozów na terenie obecnych państw członkowskich.
Strona polska uzyskała najdłuższy spośród państw kandydujących okres przejściowy na udostępnienie sieci dróg dla samochodów o nacisku powyżej 11,5 tony na oś.
Do końca 2006 roku ograniczony będzie dostęp przewoźników państw członkowskich do polskiej sieci kolejowej (20% rocznej zdolności przepustowej).
10. Podatki.
Polska zdecydowała się przyjąć i wdrożyć całość unijnego prawodawstwa, zgłaszając jednak kilka postulatów o wprowadzenie okresów przejściowych w odniesieniu do podatku VAT i akcyzy w niektórych sektorach rynku. Trzeba zaznaczyć, że Polska wynegocjowała najwięcej (osiem) okresów przejściowych w tym obszarze negocjacyjnym. Najistotniejsze z tych ustaleń dotyczyły sektora budowlanego, rolniczego oraz tytoniowego.
13. Polityka społeczna i zatrudnienie
Jedyne rozwiązanie przejściowe, o jakie zdecydowano się wystąpić, dotyczyło wymagań bezpieczeństwa i higieny użytkowania sprzętu przez pracowników. Okres przejściowy w tej kwestii został przyznany do końca 2005 roku.
14. Energia
Polska wystąpiła o zastosowanie okresu przejściowego w zakresie obowiązującego w Unii przepisu o utrzymaniu zapasów ropy naftowej i/lub paliw ciekłych. Obowiązek utrzymania zapasu paliw na poziomie 90-cio dniowego zużycia, obowiązywał będzie w Polsce od 1 stycznia 2009 roku.
19. Telekomunikacja i technologie informacyjne
Choć Polska zdecydowała się wystąpić o tylko jeden okres przejściowy w tym obszarze, (dotyczący stosowania ograniczenia wagowego dla usług pocztowych zastrzeżonych dla operatorów świadczących usługi powszechne), najwięcej emocji budziły kwestie związane z liberalizacją rynku usług telekomunikacyjnych i pocztowych, na których monopolistami pozostawały długo Telekomunikacja Polska oraz Poczta Polska. Rynek ten zdecydowano się uwolnić dla operatorów i przedsiębiorstw wywodzących się z Unii do dnia uzyskania członkostwa w UE bez występowania o przyznanie na tym polu okresów przejściowych.
22. Środowisko.
Obszar ten okazał się, obok „Rolnictwa” i „Swobodnego przepływu kapitału”, jednym z najtrudniejszych rozdziałów negocjacji. Tutaj też obowiązywać będą najdłuższe okresy przejściowe, z których część zakończy się już 31 grudnia 2004 r., a część rozpocznie się w 2008 i będzie obowiązywać do roku 2017. Przyznane okresy przejściowe dotyczą m.in.: oczyszczania ścieków komunalnych, redukcji zawartości siarki w paliwach płynnych, ograniczenia emisji zanieczyszczeń, poziomu recyklingu szkła, plastiku i metalu, modernizacji istniejących i budowy nowych składowisk odpadów, etc. (w sumie 10 okresów przejściowych).
24. Wymiar sprawiedliwości i sprawy wewnętrzne.
Polska nie występowała w tym obszarze o rozwiązania przejściowe i zdecydowała się zaakceptować dorobek prawny Unii. Jednak trzeba zwrócić uwagę na szczególne znaczenie kwestii związanych z dorobkiem prawnym Schengen. Polska granica wschodnia stanie się zewnętrzną granicą UE, co wiąże się z podjęciem starań mających na celu uszczelnienie granic i zabezpieczenie przed nielegalną migracją i zatrudnieniem . Wiele emocji wzbudziła w Polsce konieczność wprowadzenia z dniem 1 lipca 2003 r. obowiązku wizowego dla obywateli Białorusi, Rosji i Ukrainy.
26. Stosunki zewnętrzne.
Polska zdecydowała się przyjąć całość uregulowań prawnych Unii. Problemem o szczególnym znaczeniu dla Polski będzie dostosowanie do prawa wspólnotowego umowy o handlu i żegludze zawartej z Japonią oraz Traktatu o stosunkach handlowych i gospodarczych ze Stanami Zjednoczonymi. Polska będzie także musiała wypowiedzieć dużą część umów międzynarodowych, co nie spowoduje jednak negatywnych skutków międzynarodowych, gdyż zastąpią je umowy podpisane przez Unię Europejską.
29. Finanse i budżet.
Negocjacje rozpoczęły się 26 maja 2000 r. i trwały aż do szczytu w Kopenhadze 13 grudnia 2002. Najważniejszym postulatem polskiej delegacji było uzyskanie takich warunków finansowych akcesji, by Polska stała się beneficjantem netto od pierwszego roku członkostwa. UE przewidziała dodatkowe 443 miliony EURO rekompensaty dla Polski w pierwszym roku członkostwa. Wynegocjowano też przesunięcie części środków z funduszy strukturalnych na rekompensatę budżetową (w przypadku Polski jest to znacząca kwota 1 miliarda EURO). Dodatkowo, Polsce zostały przyznane środki na finansowanie dostosowań granicy zewnętrznej oraz polskich lotnisk międzynarodowych do wymogów Schengen w wysokości 280 milionów EURO.

1. Free movement of goods
Though initially Poland accepted the acquis communautaire in this area, on 28th November 2001 Poland re-opened this particular negotiation area and requested a transition period as regards the adoption of the Community procedures of the pharmaceuticals’ registration by 31st December 2008. The above decision has been justified on the grounds of excessive budget expenditures to be incurred by Poland and Polish entrepreneurs in the course of the implementation of the acquis in this area.
2. Free movement of persons
In this area, Poland has accepted the acquis communautaire in full. The only anxieties and reservations concerning this particular negotiation area have been expressed on the part of the European Community in view of the threatening destabilisation of the internal EU labour market generated by the free movement of persons. Eventually, the EU requested transition periods 2+3+2, i.e. in the form of limits imposed on the access to the Union labour market over the first two years of Poland’s membership in the EU with the possibility of prolongation by additional 3 years and subsequently by another two years in case of considerable destabilisation of the member states’ labour markets. Unilateral declarations of opening their labour markets for Polish employees upon Poland’s accession issued the following countries: Sweden, Denmark, Ireland, Greece, and Great Britain. Italy and France will liberalise their labour markets after a two-year period, whereas Germany and Austria are likely to request longer transition periods.
3. Freedom to provide services
Poland has accepted the acquis communautaire in full in this area, to the exclusion of three transition periods concerning: first, the implementation of the Community laws regulating the issues of the minimum level of individual funds of institutions such as co-operative banks and credit institutions; second, five-year transition period (up to 31st December 2007) for the implementation of laws regulating the issues of protection of investors on the capital market; third, the derogation of Polish Co-operative Savings and Credit Unions, Bank Gospodarstwa Krajowego and Polish Export Credit Insurance Corporation out of the powers of the so-called First Bank Directive.
4. Free movement of capital
This negotiation area, and in particular the regulations concerning the acquisition of immovables by the foreigners, has turned out to be the most difficult one (with the exception of the agricultural issues). Polish negotiators expressed their anxiety about sudden rise in prices of immovables and the threat in the form of speculation in immovables resulting from the predicted rise in prices. Moreover, the negotiators pointed to the emotional and historical aspect of the debate in Poland on land acquisition by the foreigners. Eventually, the European Union gave its consent to two transition periods: five years of protection for Polish real estate market against the acquisition of the so-called ‘second houses’ by the foreigners and twelve-year period during which Polish legal regulations concerning the acquisition of rural areas and woodlands can be applied.
6. Competition policy
In the course of negotiations, Poland has promulgated the maintenance of the existing rules of the functioning of Special Economic Zones (SEZ) as applied to those companies which started their activity within those zones prior to 1st January 2001. Eventually, it has been decided that the existing rules of the functioning of the SEZ will be maintained till 2011 in case of small, and till 2010 of medium enterprises. There has been fixed an augmented level of public aid for the environmental protection investments within the regulations provided for in the 22nd negotiation area (‘Environment’). Moreover, there have been laid down the rules for the restructuring of Polish metallurgy assuming the reduction of its production capacity and employment in Polish steelworks as well as the attainment of the break-even point by the year 2006.
7. Agriculture
Considering the size of Polish agricultural sector and the conditions of its functioning, this negotiation area creates the greatest difficulties and controversies, evokes the strongest emotions, and carries the greatest significance. The negotiation position in this area is the amplest and it comprises 465 pages long documentation . From the very beginning of the negotiation process, the amount and the length of the period within which the highest level of direct payments should be attained presented one of the most difficult issues. So did the issue of the implementation in Polish agriculture of the remaining instruments of Common Agricultural Policy. On 13th December 2002, in Copenhagen, it was decided that Poland would receive compensatory payments amounting to circa 60 % of the financial assistance given to the EU farmers in the period 2004-2006
(55 % in 2004, 60 % in 2005, and 65 % in 2006) with the level of payments from the structural funds’ budget of Common Agricultural Policy amounting to maximum 20 % of these resources, or: 25 %, 20 %, and 15 %, respectively. The remaining part of the payments is to be financed from the State budget. From 2007 onwards, Poland will focus on the equalisation of the direct payments’ level increasing them by 30 % above the payments’ level ascribed to a given year. Moreover, in Copenhagen, it has been suggested that part of the financial resources allocated for rural areas development should be used for direct payments. The EU has given its assent to the re-allocation of maximum 20 % of the resources ascribed annually within the period 2004-2006, or 25 % in 2004, 20 % in 2005, and 15 % in 2006. Another important negotiation issue was the EU assistance for the low-volume production households. In view of the Polish negotiators’ persuasions, the level of financial assistance has been raised to 1250 EURO per household yearly, which constitutes a considerable progress as compared to the previously proposed 750 EURO.
8. Fisheries
This negotiation area has been divided into four problem groups pertaining to the management and control of the resources, the organisation of the common market, the State’s aid and the structural policy, and international fisheries agreements. In exchange for the access to the fisheries of western areas of the Baltic Sea and the EU deep-sea fisheries, Poland has decided to ‘let in’ the EU fishing boats onto Polish fisheries to the exclusion of its territorial waters. Within the quotas allocated by the Union Poland will keep the right to fisheries in currently permitted volume. Contrary to the negotiation area of ‘Agriculture’ where the allocated sums and limits aroused the greatest controversies, in the area of fisheries it has been the level of the technical adjustment of the Polish fisheries sector with respect to the EU regulations that posed the most serious difficulties.
9. Transport policy
The key (from the Polish negotiators’ point of view) issues were changing depending on the modernisation and the restructuring of the Polish largest carriers: PLL LOT, PKP, and PKS. The most perplexing problems emerged with respect to the three fundamental issues:
the permission of current EU states for the carriers from the new member states for the so-called cabotage transport (domestic transport of goods) within the territory of the current EU states. Both parties have decided to implement a three-year transition period with the possibility of its one-time prolongation by another two years in case when the companies with their seat in Poland will not enjoy the right to such transport within the territory of current member states.
in comparison to other candidate countries, Poland has successfully negotiated the longest transition period concerning the access to road network for cars with axle pressure above 11.5 tons.
By the end of 2006, the access of carriers from the candidate countries to Polish railway network will be limited (20 % of the annual transport capacity).
10. Taxation
Though Poland has accepted the acquis communautaire in full in this area, it applied for the introduction of transition periods as regards VAT and excise duty in certain market sectors. It should be stressed that Poland has successfully negotiated the greatest number (eight) of transition periods in this negotiation area. The most significant of these arrangements pertained to the building, the agricultural, and the tobacco sectors.
13. Social policy and employment
The only negotiated transition period in this area concerned the safety and health requirements for the use of work equipment by workers at work. The transition period has been granted till the end of 2005.
14. Energy
Poland has applied for a transition period with respect to the regulation operating in the EU on the maintenance of the oil and/or liquid fuels reserves. The regulation providing for the maintenance of fuels reserves at the level of 90-day usage will be in force in Poland from 1st January 2009.
19. Telecommunications and information technologies
Though Poland has decided to request only one transition period in this negotiation area (pertaining to the application of the weight limits for postal services reserved for the operators rendering universal services), the issues that have aroused the strongest emotions have concerned the liberalisation of the postal and telecommunications services market on which Telekomunikacja Polska and Poczta Polska had long acted as monopolists. It has been decided that this market should be opened for the operators and entrepreneurs coming from the Union up to the day of Poland’s accession to the EU with no transition periods in this field.
22. Environment
‘Environment’ has turned out to be one of the most difficult negotiation areas (apart from the ‘Agriculture’ and the ‘Free movement of capital’) . It also required the longest transition periods, part of which will end by 31st December 2004, and other will start in 2008 and will be binding till 2017. The transition periods in this area concern, among others, municipal sewage treatment, reduction of sulphur contents in liquid fuels, reduction of contaminants emission, level of glass, plastic, and metals recycling, modernisation of the already existing and building of the new waste yards, etc. (10 transition periods in total).
24. Justice and home affairs
Poland has requested no transition periods and accepted the acquis communautaire in full in this area. However, it should be mentioned that the issues concerning the Schengen acquis communautaire are here of high importance. Poland’s eastern border will become an external frontier of the European Union, which means that a series of initiatives aiming at the efficient border protection system against illegal migration and employment should be undertaken . An issue which evoked strong emotions was the introduction of the visa duty for the citizens of Russia, Belarus, and Ukraine to be binding from 1st July 2003.
26. External relations
In this area, Poland has accepted the acquis communautaire in full. However, what will constitute a considerable problem in this negotiation area is the incompatibility with the acquis communautaire of the provisions of the Agreement on shipping trade concluded between Poland and Japan and of the Treaty on business and economic relations between Poland and the USA. Moreover, Poland will have to cancel the majority of international agreements, which, nevertheless, will not entail any negative consequences, as they will be replaced with the agreements endorsed by the European Union.
29. Budget and finances
The negotiations in this area began on 26th May 2000 and were completed by the Copenhagen summit on 13th December 2002. The key objective of the Polish delegation was to negotiate the position of net beneficiary from the first day of its membership of the EU. The European Union allocated additional 443 million EURO of compensation to Poland during the first year of its membership and transferred part of the resources from the structural funds to budgetary compensation (in the case of Poland it amounts to a considerable sum of 1 billion EURO). Moreover, Poland was granted financial assistance amounting to 280 million EURO for the adjustment of its external borders and international airports so that they conformed to Schengen standards.

Tekst źródłowy - angielski Good morning. I am glad to be here because it is important for us all to discuss as much as possible about the future of Europe. It is also quite significant to engage in these discussions the candidate member states. Therefore, preparing the so-called Declaration of Laeken we try to stress that the candidate states should fully participate in that convention. It is very important for both Europe and the candidate countries that the latter could take part in this wide debate.
During our meeting I would like to give you an idea of the mission and the character of the convention. As it has been highlighted in the report, which has been commissioned by Prof. Kolarska-Bobińska, we have to be aware of the fact that the EU enlargement is now irreversible. Coming to the end of this process, we have to be conscious that present enlargement is quite different from the previous one, when the number of member states grew first from 6 to 9 and to 12 and, finally, to 15 countries. Present enlargement has also assumed much higher political dimension than the previous ones, especially when it is referred to as the reunification of Europe. Simultaneously, we have to be aware that Europe will be different after that enlargement and that we have to reorganise Europe so that it could function in an equally effective way after reunification. What I would like to stress here is that even if it were not for the enlargement, the internal evolution of the Union, with the monetary union, requires of Europe – what I call – a ‘qualitative jump’. Actually, it is a world-wide evolution on its own, where globalisation is a fact and where, if we want Europe to play an important role in that global world, we have to be aware of the fact that Europe needs integration. None of the member states has such an economical or political dimension that would permit Europe to play a significant role in that global world.
Within the European Union there is a great awareness of the need for such a global ‘qualitative jump’. However, this challenge is too big to be met in the usual way, i.e. the intergovernmental conference. Recently, we have had two intergovernmental conferences, in Amsterdam and in Niece, which, in fact, have not succeeded in giving the answer to this challenge. This what has happened in Niece constitutes for me the last classical form of IGC, with an preparation of functioning institutions for the accession of new member states (which is indispensable in the case of each enlargement). Therefore, Niece was necessary to prepare the EU for this enlargement and the ‘technical’ conditions of this enlargement have been specified in Niece.
So, there is nothing institutional that could stop the enlargement and I think nobody would like to hinder it. On the contrary, everybody wants to accelerate the process of enlargement negotiations, even if we are aware that there remain difficult issues to discuss. But, at the same time, we have to be conscious that if things stop at that stage – the monetary union on the one hand and the enlargement on the other – we will face the enormous risk of crisis in the European Union. I do not wish to sound too pessimistic. What I have just said does not mean that a kind of catastrophe will befall us. What I mean is that if we can avoid it, if we can add that to negotiations and define somehow that change and that indispensable for Europe ‘qualitative jump’, let’s do it that way.
Two years ago, during the convention on fundamental rights, the one which succeeded in defining the charter of fundamental rights for the European Union, there emerged an idea to organise a new convention. A convention, where the members of the European Parliament, of the European Commission, of the member states’ parliaments and governments as well as the members of the candidate states’ parliaments and governments would be equally represented and would be given a year to prepare the framework of the functioning of future Europe.
So, we have been confronted with an ambitious challenge but, at the same time, there is no guaranty that the convention will succeed. However, I think that it is worth at least trying to succeed and to start with great determination, if we want to achieve satisfactory results. As I had a chance to take part in the previous convention, I can assure you that such a convention creates its own “chemistry”. It is essential that the members of such a convention were not limited by close mandates from their parliaments and governments, from the European Commission or the European Parliament, but had sufficient autonomy of thinking and discussion on the future of Europe. Simultaneously, we have to be aware that it’s much difficult, as a convention is not a place like a parliament, where you can vote. Any conclusions are formed rather by discussion, where the president announces a consensus or at least a large consensus as regards given proposition.
The presidium of the convention plays a key role in the working of that convention. Having listened to all members of the convention, the presidium has to propose the final version of the treaty and lay out directions in the future work of the convention. Simultaneously, it is very important for the credibility of the convention to maintain contact with the society and other large groups outside the convention. That is why a civil forum has been created, where the NGOs and other organisations have the possibility to introduce their proposals and to assume certain attitude towards the work of the convention. It is quite significant that it happens not only at the European, but also at the national level. That way, the delegates of the parliaments and governments of particular member states have the possibility to get acquainted with the public opinion in their own country. I was very glad to hear that you had already opened such civil forum here, in Poland. I think it is indeed important that the society should be provided with plentiful information on what is currently discussed at the convention.
What will be the ultimate result and the influence of the convention on the process of reunification, it is hard to say. What I know, is that the greater the consensus will be, the stronger will be the impact of the convention. If the work of the convention were limited only to the publication of its suggestions and recommendations, that would certainly constitute a document to analyse for the IGC, but there would be no big impact on the discussions. However, if the texts were, let’s say, in a quasi-treaty form, then it would be very difficult for the IGC not to take it into account. On the other hand, if the report of the convention is a catalogue of possibilities, a kind of a shopping list, it will be an interesting document for a library but not for the IGC.
Although it is difficult to foresee what will be the final result of the convention, it is evident that it will be an important factor on the way to the success that I have mentioned above. And here again I can give you an example from the previous convention. Nobody believed then that the convention would manage to produce some effect. Finally, the convention drew up a charter formulated in legal terms. In other words, it was that kind of a charter which you have to integrate into the treaty without changing a word there. And that happened, in a certain sense, to the surprise of the European Council, as they had no other choice than to sign the charter. I hope that there will be more such surprises within the present convention.
Now, I will discuss the items that will be at order in the convention. First thing, which is extremely important and which I would like to stress, is that the text of Laeken specifying the prerogatives of a member of the convention within his/her mandate, is a very lengthy one. It seems to me that this text contains more than 50 questions, however, for me it’s not so important that the convention should answer each of these 50 questions. More important is to provide the participants of the convention with large and open mandate, which was not ensured after Niece, as it was there, in the European Council, where first emerged the idea to initiate such a debate. An agenda of four points was drawn up, however, these points were formulated so narrowly that they hardly allowed for a serious debate. So, our task is to have the Council issue a text that would enable the members of the convention to discuss more freely. Once more, I would like to stress that it is not necessary to have an answer to each of the 50 questions included in the text of Niece and that the convention has the right to answer questions not entailed by the text of Laeken. I even dare presume that what we will discuss there will be such questions.
Trying to classify somehow the issues we have to tackle, we could regroup them around three or four wider issues. One of these issues will discuss the role of the European Union after it attains its final shape, which is directly linked to the question of the Union’s competencies. Simultaneously, I would like to point out that, contrarily to what most people think, we do not have only one treaty. We have seven treaties, which may bring about a number of ambiguities and misunderstandings, especially when the competencies are not always defined in the same way in each of these treaties. Second issue that we have to confront, discussing about the finality of the European Union, is whether the way the Union functions today – i.e. the so-called tri-policy, or three pillars (social and economic policy, within the competencies of the European Community, defence and common external policy, and justice and internal security, within the competencies of the Council of Ministers) –is effective enough, and whether we should not seek more global approach to current affairs within the European Union. It means that we should reorganise the second pillar so as to render it similar to the first one, which is more community-orientated. Analysing public opinion polls, certainly within the European Union, it becomes evident that the society has great expectations for the Union especially in these areas where the Union is least integrated and least efficient. People expect from the European Union better internal security, they expect an efficient fight against international terrorism and criminality, against drugs and so on; they expect legal regulation of immigration as well as justice which in certain cases would function at the European level; people expect that Europe will play a real role both in world discussions and world conflicts. But all this refers to the sectors where the Union works on an intergovernmental level, often with less efficiency, which is due to the irrefutable need of unanimity at that level.
In my opinion, we cannot debate on competencies without having discussed on the instruments with which these competencies will be exercised. Moreover, we cannot make a list of a clear-cut repetition of competencies, meaning that some of them lay within the European, and the others within the national competence. What should be also stressed here is that there is a large area of mixed competencies, which means that the Union makes use of various instruments, such as the European legislation, or European benchmarking void of legal interference in the national matters of particular member states. We also have to define certain areas with which the Union will not interfere. So, I think that this debate is extremely important as it will enable us to avoid unnecessary misunderstandings in the future.
Second issue, around which we would group our discussion topics, are the institutions, as it is clear that if we want the European Union to function effectively, we also need institutions that can work and make decisions in a reliable and competent way. This means – and in view of our discussion on competencies we also have to take into account the fact that the Europe of tomorrow will constitute much more consolidated political union than the Europe of yesterday – that we also need institutions that have democratic credibility at the European level. And it seems to me that two or three issues of high importance can be linked to that problem.
First, I think that, apart from the approval of the basic treaty, the rest of the matters at the European level should be resolved by a qualified majority and not by unanimity. It is essential, as the unanimity simply means, in a negative sense of the word, ‘veto’, which certainly is not conducive to a dynamic discussion. In fact, it is very difficult, when everybody around the table has a veto. In order to have a dynamic discussion we have to be aware, as the participants of this discussion, of the risk to be in a minority. The experience shows that where the majority decision making is possible, within the European Union the debate often ends with a consensus. However, if there were the right of a veto, probably the consensus would not be possible.
Second, we should reinforce the EU institutions, and I am referring now to these institutions which work in compliance with the European interest. This is the role of the European Commission, this is the role of the European Central Bank, of the European Court of Justice, this is, to a certain extent, the role of the European Parliament. We have to reinforce these institutions, if we want the Union where every member state feels at ease. We have to adapt these institutions to the new situation of reunified Europe.
Third, it is clear that we need more transparency, we need better understanding of what the Union is among the citizens of particular member states and candidate countries. And the prior condition to be satisfied are clear and understandable texts. We have to formulate a treaty which would contain not only the results of the so-far discussions on competencies and institutions, but also the texts of the existing treaties and the charter of fundamental rights, and we should compile this in one easily comprehensible text. Such treaty would give Europe, what some call, the constitutional basis. However, I do not attach such significance to the concept of ‘constitution’. At the same time, I do realise that the term ‘constitution’ is usually associated with the concept of ‘state’ and I would not like to be misunderstood. Instead, we can speak of a basic treaty, or a constitutional treaty, in order to stress that it is still a treaty between the nations, between the member states, and that nobody wants to create one super state, something like the United States of Europe. Actually, the idea is to have Europe integrated in such a way that it can function effectively and form forceful decisions. In the beginning, the integration entailed Germany, France and several other countries – we were 6 at this time – establishing the European Community of Coal and Steel. Later on, the integration was to cover the whole economy to such extent that a war between the member states would be impossible in the future. It constituted the basis for 50 years of peace and stability in Western Europe. However, what was most essential was that there emerged the supranational authority, which dealt with a number of matters common for the member states.
It seems that today the risk of war between the European nations does not exist anymore, even if we are to blame, to a certain extent, for what happens in the Balkans. But this is exactly the reason why I think the European Union has a significant role to play. Now it is clear that these 50 years of integration and stability it was the privilege of Western Europe and that the political agreement in Jalta did not correspond to any historical or cultural aspects and only caused an unnecessary split-up in Europe. It is also obvious that the states and the nations of Central and Eastern Europe historically and culturally belong to Europe, and after the end of the cold war it became evident that they should join the Union. Simultaneously, the European Union itself, with the monetary union, has achieved the level of integration requiring from us one step further, which was already evident in Maastricht. On the other hand, the end of the cold war was also the beginning of the globalisation. Now, when globalisation is so controversial for the majority of people, in my opinion it is an enormous chance for us to attain more sustainable world. However, it will be possible only if we maintain the equilibrium between the most important poles in the world. And one of the Europe’s challenges is to organise itself so that it can become one of these important poles in the modern world.
Summing up, first, after the enlargement we need different organisation of Europe, if we want it to function effectively; second, the monetary union requires greater political integration; and third, it is a most prior task for Europe to become one of these important poles in our globalised world. And the immediate challenge of the present convention is to formulate a treaty, which would highlight the tasks for Europe in this century. Thank you very much.
The role of the delegates to the convention should not be limited merely to the participation in the debate. The information they obtain at the convention, the conclusions they form at the convention should be passed on in their own parliaments and governments. Let’s hope that particular parliaments and governments are aware of the fact that we need there people who are capable of playing that role. Moreover, it is obvious that, as the convention is open, the delegates are obliged later on to explain and defend the position they adopted during the convention, of which their parliament or government will be notified sooner or later – it will be made public. In other words, this is exactly what I call the “chemistry” of the convention.
Certainly, indeed you are right that some things are for me so evident that I sometimes forget to explain them. Subsidiarity is a key concept in the whole construction of the European Union and for the majority of us it means that the Union “has to do less”. I would rather say that in the name of subsidiarity the Union has also to do something more. I will give you my own example to explain that. For 15 years I have been trying to transform Belgium from a Unitarian state to a federal one with wide autonomy of the regions, all in the name of subsidiarity. So, both in the Union and in the member states separately, there is a double movement of competencies: on the one hand, there is a growing number of matters that lay within the competence of particular regions, and, on the other hand, more and more issues fall under the competence of the Union, as it is better to work and take decisions together. It is then indeed very important that we should try to function that way.
I agree with you that in the sectors where Europe is most integrated we have sometimes gone too far in various regulations. Most frequently, whenever people complain about too many regulations, they blame ‘this European bureaucracy from Brussels’, the spiritus movens of all regulations. However, I would advise you to get acquainted with the process of drawing up such regulations and how they further evolve. You will see that most of these ‘superfluous’ regulations have been stipulated for not by the Commission itself, but by a given member state in order to defend its national interests. Therefore, you must admit at some point that ‘ok. this is beyond the competence of the Union’. It seems to me that over the past few years, especially as regards the organisation of employment, the functioning of the Union is based more on the benchmarking than on the regulations. For instance, the convergence of the monetary union was realised by benchmarking. We knew that the budget deficit could not exceed 3 % GDP (Gross Domestic Product) and that the public debt could not reach more than 60 % GDP but it was our choice in what way we would achieve this! Each member state was free to choose the method; it was not important whether we would observe these terms through tax adjustments or austerity package, or some other way! So, we should understand that at this level each member state can work out its own way of functioning.
I think that it would be highly advantageous for everybody, for the European administration, for the national administration and as for the citizens, if there was more transparency in the way the Union works. The complexity of the EU treaties often makes it difficult to understand, for instance, the process of the decision-making within the European Union. So, if we can make it more transparent, it will be a good thing for everybody. There is one more thing of great significance which I would like to underline. Currently, there is a basic triangle within the Union: the European Commission, the European Parliament, and the European Council of Ministers, and, simultaneously, the role of the parliaments of particular member states, which consists in assigning mandates for ministers, is extremely crucial. Unfortunately, I regret to say that a great number of national parliaments and governments very often underestimate or even neglect that role, which only increases the distance between the Union and particular member states. So, it is vital that the bridge between the European and national level was maintained, also within various national institutions.
I will begin with the question about solidarity, which is related to the regional and agricultural policy. I think that solidarity, even in socio-economic terms, has always been a basic element of the European integration. Most frequently, solidarity also constitutes a form of well-understood self-interest, which means that to maintain the present degree of integration, especially after the monetary union, we need to introduce adequate dose of convergence and coherence within the Union. This is the basic idea of the regional and structural policy within the European Union. As it has already been mentioned in the report, it can also constitute a reaction to certain anxieties within the European Union towards the enlargement. People feel apprehension about the immigration, unstable situation on the labour-market, and so on. By the way, when Spain, Greece, and Portugal joined the Union, the same fears were revived. The truth is that after joining the Union, these three countries, which had been authoritarian systems in the past, not only managed to reinforce their democracies, but also developed their economies to such a degree that today there is no reason for emigration nor any threat on the European labour-market. It seems to me that the same could be said of the reunification of Europe. Therefore, we should invest as much as possible in Europe, for the time being within the Union and the candidate countries but in the near future just within the Union, so as to accelerate the development of the candidate states and to enlarge the market for the European products. So, it is in our common interest to explain the concept of solidarity to the European citizens, on both sides. You may compare this, to a certain extent, with what happened after the Second World War in America and Western Europe, with the Marshall plan. It will be a vital part of the discussion on the enlargement.
In the enlargement negotiations we have arrived at highly problematic chapters, the more so as they are difficult for the European Union itself. It is obvious that discussing on agriculture, or the structure of farms, we also discuss about the financial framework of the European Union. Within the Union there emerged certain divergence of positions in the course of that debate – all member states were in favour of the enlargement but none wanted to pay more or receive less. Similarly, everybody is aware of the fact that this situation requires some additional costs. It is then a serious problem, which should be overcome by the Union itself. It is also the reason why at the convention we have to discuss certain issues not included in the text of Laeken. One of these issues relates to the financial structure of the Union and it should be stressed here that it is not the question of who will contribute what, as this would mean the return to the beginnings of the European Union, to the European Community of Coal and Steel. It rather refers to the fact the Union needs its own financial resources, which constitutes one of these issues to be thoroughly discussed.
If I have understood next question correctly, the one on the decentralisation of the regions, I think that the Union, being an integrating factor, allows for decentralisation and autonomy of regions within particular member states. In some states the pressure of public opinion on decentralisation is greater than in the others, which is often related to their history. However, in some cases regionalisation led to a split-up, as for instance, in former Tchechoslovakia. By contrast, the integrated European Union is able to allow for partial decentralisation.
Next question is partially related to my own experience. Travelling as the Prime Minister across South America, Africa and Asia, I noticed that they had greater expectations there of the European integration than they have here, in Europe. Most probably it followed from the fact that in those remote parts of the world people need concrete poles, some orientation in the modern world and the European Union constitutes for them a model of political and economic evolution which is unattainable in South America or in Asia. And the fact that these expectations are greater outside the Union than within the Union should compel us to reflection.
What I am speaking about today, will be also discussed at the convention. Though I do not know what will happen in 10, 20, 30 years, I am sure that if at the beginning of the 60s we had tried to explain someone what would be the shape of integrated Europe at the beginning of the 21st century, nobody would have believed us. Frequently, we have an impression that the process of reunification goes very slowly, but when we look back it turns out that it has gone further than we expected. Though I cannot foresee how it will evolve, I am convinced that Europe can play an important role. However, only under one condition: if it is unanimous and if it is properly organised. I will give you a concrete example to illustrate this point. It is related to the World Trade Organisation (WTO), where the custom tariffs are negotiated and where a special sub-commission deals with the matters of the European Union. In the case of similar negotiations Europe has an enormous influence. If, in the future, the European Union is represented in the International Monetary Fund and in the World Bank by one voice – the European Commission and the European Central Bank – the influence of Europe on these institutions will be much stronger than it is today, when the Union is represented by each member state separately. So, this example indicates what should be done to acquire real influence in the modern world. On the other hand, it is extremely difficult to make that step forward. The fact that it is Javier Solana who is responsible for the EU foreign gives Europe an opportunity for better stabilisation. Some time ago, Javier Solana said that we have to dare dream of such a Security Council where there would be one European seat for the European Union. But indeed this remains only a dream. However, the Union evolves step by step and even if these were sometimes merely very small steps, we go step by step continuously for the past 15 years! Each time you make a step forward, do not stop and do not be ashamed even if it is a small step.
The following question refers to the relations with the United States. I think that in the globalised world of today there exists a real danger of a unilateral domination of one power, which has nothing to do with anti-Americanism. It only means that the world needs an equilibrium where the interest of everybody would be taken into consideration and where no state would impose its own viewpoint in the name of its interest. It seems to me that, for instance, it is a good thing for the world that in the negotiations of Kyoto on environment the European Union adopted a position which took into account the general interest of different parts of the world, and not the position similar to that of the government of [George] Bush which rejected Kyoto resolutions only because it was beyond the interest of America. The same refers to the discussion of Duncan on racism. Similarly, I think that there is more equilibrium, more objectivism in the position assumed by the EU and the Middle East than in the unilateral support given by the United Nations to Israel. Therefore, if we want to restore world stability, it is crucial that we could talk with each other and that we tried to achieve greater equilibrium, also within particular institutions. It seems that here, in Europe we attach much more significance to the role of the United Nations than, for instance, in the United States, which follows from the fact that within the United Nations there is a framework within which any decisions are pronounced and enforced and where everybody can have a voice. Thus, taking into account the level of Europe’s integration, its unanimity, and its potential, we can venture the statement that Europe’s contribution in ensuring greater stability in the world can yet be enormous.
There is one more question left that I have not answered, namely the one on voting of the candidate countries at the convention. To be honest, I do not think that it is so important and I will explain why. As I have already mentioned in the introduction, the convention cannot vote. Voting would mean that the vote of a member of the European Parliament has the same power as the vote of a member of the parliament of a given member state, and the vote of a member of national parliament has the same power as the vote of a representative of the national government or the same as the vote of a representative of the Commission. At the previous convention on fundamental rights we made an attempt at voting and the conclusion is straightforward – we should never ever repeat this again.
In the text of Laeken there is only one sentence describing a situation where complete consensus between the 15 member states would be possible to achieve, but I can merely dream about it. However, it does not entail the candidate countries. First, I doubt that complete consensus between the 15 member states was easily attainable. Second, I cannot picture a situation where complete consensus, or at least large consensus, between the member states differed drastically from the position adopted by the candidate countries. The participation of the candidates in the convention might be conspicuous yet for another reason – then the candidate states could participate in the ‘chemistry’ of that convention. A convention of the 15 member states without the candidate countries would constitute the source of many frustrations and future problems. Currently, if the convention ends with some conclusions and resolutions, it is usually achieved with significant contribution on the part of the candidate countries. The Bureau and the Presidium will focus their attention to make sure that the candidates are engaged in the debate and I hope that, as you have already done in Poland, other candidate countries will use that convention to launch a similar debate on their own. I think that it is important to provide the society with accurate information on ‘what is going on in the EU’. Simultaneously, we have to avoid emotional discussions, as it only leads to misunderstandings and, for instance, to negative referendum results, even within certain member states. It happens so because the participants of the discussion, acting in a too emotional way, show obvious bias, which actually has nothing to do with what Europe is about.
Summing up, we will have yet to face serious discussions at the convention. Though I do not dare foresee now what will be the most difficult points, I know that the convention must avoid discussions on general concepts, slogans, or one-liners. For instance, debating whether we want a federal Europe or not – for me it makes no sense, as nobody so far has ventured an explanation what it really means. Sensible discussions would try to find an answer to the question what we want to achieve, whether we want to do this together, how we are going to achieve this, and whether together we are strong enough to succeed. The experience of the European Union demonstrates that in order to succeed we need institutions functioning in accordance with the common European interest, which is something more than an addition to the national interest. These institutions should render a similar debate possible, as for instance, the Council of Ministers, where the delegates represent their nation and their state, where they can defend their states’ interests, but in a dialogue with institutions of European approach. And, to illustrate the point more clearly, I will give you an example of my own country. Prior to the monetary union, we related our currency to the Deutsche mark, and the autonomy of the Belgian National Bank was limited to barely a few minutes passing between a decision of the Deutsche Bundesbank and our decision. Moreover, the decisions resolved by the Deutsche Bundesbank took into account only German interest. Thus, during the reunification of Germany both Deutsche marks were meant to have equal value – in accordance with the decision of Helmut Kohl – and that is why the Deutsche Bundesbank was forced to introduce restrictive monetary policy based on high interest rates, which we had to follow. By contrast, on the day when we joined the monetary union, the European Central Bank was established, in the Council of which Belgium has its representative. And although the European Central Bank has a seat in Frankfurt, it pronounces and enforces decisions in compliance with the general European interest.

Podczas naszego spotkania chciałbym Państwu nieco przybliżyć cel i charakter tego konwentu. Tak, jak to zostało przedstawione w sprawozdaniu, w którego przygotowaniu brała udział profesor Kolarska-Bobińska, musimy być świadomi faktu, iż rozszerzenie [Unii] jest w tej chwili już nieodwracalne. Zbliżając się do końca tego procesu, musimy zdawać sobie sprawę, iż obecne rozszerzenie jest zupełnie inne od poprzedniego, kiedy to ilość państw członkowskich wzrosła najpierw z 6 do 9, potem do 12 i w końcu do 15 krajów. Obecne rozszerzenie charakteryzuje się również dużo większym wymiarem politycznym, zwłaszcza kiedy mówimy o nim jako o zjednoczeniu Europy. Ponadto powinniśmy być świadomi tego, iż Europa nie będzie już taka sama po rozszerzeniu, i że musimy ją tak przeorganizować, by mogła skutecznie funkcjonować po zjednoczeniu. Chciałbym również zaznaczyć, że nawet jeśli nie bralibyśmy pod uwagę dalszego rozszerzenia, to wewnętrzna ewolucja Unii, a razem z nią unii walutowej, sprawia, że Europa i tak potrzebuje – jak ja to nazywam – ‘jakościowego skoku’. Jest to ewolucja na skalę światową, tocząca się swoim własnym rytmem, gdzie globalizacja stała się już faktem, i gdzie – jeśli chcemy, by Europa odegrała istotną rolę w tym zglobalizowanym świecie – musimy być świadomi konieczności jej integracji. Żadne z państw członkowskich nie ma samodzielnie wymiaru politycznego lub gospodarczego, pozwalającego Europie na odegranie istotnej roli w zglobalizowanym świecie.
Unia Europejska doskonale zdaje sobie sprawę, że taki globalny ‘jakościowy skok’ jest jej potrzebny. Jednocześnie jest to wyzwanie zbyt duże, by stawić mu czoła w tradycyjny sposób, tzn. na drodze konferencji międzyrządowej. Ostatnio odbyły się dwie konferencje międzyrządowe, w Amsterdamie i w Nicei, które tak naprawdę nie dały odpowiedzi na to wyzwanie. To, co wydarzyło się w Nicei, jest dla mnie ostatnią klasyczną formą konferencji międzyrządowej [IGC], gdzie miało miejsce przygotowanie działających instytucji do przyjęcia nowych członków (zresztą niezbędne przy każdym rozszerzeniu). Analizując [badania] opinii publicznej, a mam oczywiście na myśli opinię publiczną wewnątrz Unii Europejskiej, staje się jasne, że społeczeństwo ma największe oczekiwania względem Europy na tym polu, gdzie Europa jest najmniej zintegrowana a jej funkcjonowanie najmniej efektywne. Ludzie oczekują od Unii większego bezpieczeństwa wewnętrznego, oczekują skutecznej walki z międzynarodowym terroryzmem i przestępczością, walki z narkotykami; oczekują uporządkowania prawnego imigracji oraz wymiaru sprawiedliwości, który w pewnych przypadkach funkcjonowałby na szczeblu unijnym; oczekują też, że Europa rzeczywiście odegra rolę w światowych debatach, a nawet w światowych konfliktach. Ale to dotyczy sektorów, gdzie Unia „działa” na szczeblu międzyrządowym, i to często z mniejszą efektywnością, z tego powodu, że na szczeblu międzyrządowym zawsze niezbędna jest jednomyślność.
W moim przekonaniu nie można rozmawiać o kompetencjach bez uprzedniego przedyskutowania sprawy narzędzi, które pozwolą na wyegzekwowanie tychże kompetencji. Jednocześnie nie można zrobić listy jednoznacznie określonych kompetencji w tym sensie, że, jedne leżą w gestii Unii, a inne w gestii poszczególnych państw. I to właśnie stanowi podstawę regionalnej i strukturalnej polityki Unii Europejskiej. Może to być też, jak już zostało wspomniane w sprawozdaniu, odpowiedzią na niektóre obawy krajów Unii wobec rozszerzenia. Ludzie obawiają się imigracji, trudniejszej sytuacji na rynku pracy, itd. Nawiasem mówiąc, kiedy Hiszpania, Grecja i Portugalia przyłączyły się do Unii, od nowa pojawiły się te same obawy. W niektórych krajach presja opinii publicznej w kwestii decentralizacji jest bardzo silna i często ma to związek z historią danego państwa. Jednak w niektórych przypadkach regionalizacja doprowadziła do rozłamu, na przykład, w Czechosłowacji. Natomiast zintegrowana Unia Europejska może sobie właśnie pozwolić na częściową decentralizację.
Następne pytanie częściowo wiąże się z moim własnym doświadczeniem. Podróżując jako premier po Ameryce Południowej, Afryce i Azji często spotykałem się z dużo większymi oczekiwaniami dotyczącymi integracji Europy, niż w samej Unii. Wynikało to zapewne z faktu, iż w tamtych częściach świata ludzie potrzebują konkretnych biegunów, orientacji we [współczesnym] świecie, a Unia Europejska stanowi właśnie taki model ewolucji [systemowej], nieosiągalny w Ameryce Południowej czy w Azji. To, że te oczekiwania są dużo większe poza Unią, niż w samej Unii Europejskiej, powinno nas skłonić do zastanowienia.
Omawiana tu z Państwem tematyka, będzie zapewne przedmiotem dyskusji podczas konwentu. Nie wiem, co stanie się za 10, 20, 30 lat. Natomiast wiem, że gdybyśmy na początku lat 60-tych próbowali komuś wytłumaczyć, jak będzie wyglądała zjednoczona Europa u progu XXI wieku, nikt by nam wtedy nie uwierzył. Często mamy wrażenie, że to proces przebiega bardzo wolno. Lecz kiedy spojrzymy na to z pewnym dystansem, okaże się, iż zaszliśmy dalej, niż podejrzewaliśmy. I chociaż nie można przewidzieć, jak się wszystko potoczy, jestem przekonany, że zjednoczona Europa odegra dużą rolę. Jednak pod warunkiem, że będzie jednomyślna i odpowiednio zorganizowana. Widać to na konkretnym przykładzie Światowej Organizacji Handlu [WTO], gdzie negocjuje się wysokość stawek celnych i gdzie funkcjonuje specjalna komisja zajmująca się sprawami związanymi z Unią Europejską. Przy tego rodzaju negocjacjach wpływ Europy jest naprawdę bardzo duży. Jeśli uda nam się w przyszłości doprowadzić do sytuacji, w której Unia byłaby reprezentowana w Międzynarodowym Funduszu Walutowym [IMF] i w Banku Światowym przez jeden głos – Komisję i Bank – wpływ Europy na te organizacje będzie znacznie silniejszy, niż obecnie, kiedy Unia reprezentowana jest przez każde państwo członkowskie oddzielnie. Ten przykład jasno pokazuje, co trzeba zrobić, by Europa miała realny wpływ na bieg zdarzeń we [współczesnym świecie]. Z drugiej strony – jak ciężko wykonać ten krok naprzód. Z faktu, iż Javier Solana jest odpowiedzialny za politykę zagraniczną Unii, wynika szansa Europy na większą stabilizację. Javier Solana kiedyś powiedział, że powinniśmy zabiegać o Radę Bezpieczeństwa, w której byłoby jedno miejsce dla Unii Europejskiej. Na razie pozostaje to w sferze marzeń. [Zwróćmy jednak uwagę, że] Unia rozwija się sukcesywnie krok po kroku i chociaż czasem były to tylko małe kroczki, to robimy to sukcesywnie przez ostatnie 15 lat. W momencie, kiedy uczynicie jakikolwiek krok do przodu, nie zatrzymujcie się i nie wstydźcie się, jeśli nawet będzie to tylko mały kroczek.
[Kolejne pytanie] dotyczy relacji ze Stanami Zjednoczonymi. Uważam, że w obecnym zglobalizowanym świecie istnieje groźba dominacji jednego super-mocarstwa, a stwierdzenie to nie oznacza żadnego anty-amerykanizmu. Chodzi wyłącznie o to, iż świat potrzebuje równowagi, w której byłby brany pod uwagę interes wszystkich stron; gdzie żadne mocarstwo nie narzucałoby swojej wizji w imię własnego interesu. Uważam na przykład, iż dobrze się stało, gdy podczas negocjacji w Kyoto na temat ochrony środowiska, Unia Europejska zajęła stanowisko uwzględniające ogólny interes różnych części świata, a nie takie jak rząd Busha – odrzucające postanowienia dlatego, że nie leżały one w interesie Ameryki. To samo dotyczy dyskusji Duncana na temat rasizmu. Wydaje mi się również, iż stanowisko Unii Europejskiej i Bliskiego Wschodu wykazuje się większą obiektywnością niż jednostronne poparcie ONZ dla Izraela. Dlatego – by sytuację na świecie uczynić bardziej stabilną – niezbędne jest, byśmy potrafili ze sobą rozmawiać i próbowali osiągnąć większą równowagę, również wewnątrz [poszczególnych] instytucji. Tutaj, w Europie, przywiązuje się większą wagę do roli Organizacji Narodów Zjednoczonych, niż, na przykład, w Stanach Zjednoczonych. Wynika to zapewne z faktu, iż wewnątrz ONZ znajdują się pewne ramy, według których podejmuje się decyzje, i gdzie każdy ma głos. Biorąc pod uwagę poziom integracji Europy, jej jednomyślność i jej potencjał, można śmiało powiedzieć, że ma ona dużą szansę na znaczny udział w osiągnięciu większej stabilizacji na świecie.
Zostało jeszcze jedno pytanie, na które do tej pory nie udzieliłem odpowiedzi, mianowicie to o głosowaniu krajów kandydujących podczas konwentu. Szczerze mówiąc, nie wydaje mi się, by miało to jakieś większe znaczenie i zaraz wyjaśnię, dlaczego tak uważam. Tak jak już wspomniałem we wstępie, w trakcie konwentu nie można głosować. Głosowanie oznaczałoby, iż głos członka Parlamentu Europejskiego ma taką samą wagę, co głos członka parlamentu danego państwa, a głos członka parlamentu danego państwa tę samą wagę, co głos przedstawiciela rządu danego kraju lub przedstawiciela Komisji. Podczas poprzedniego konwentu na temat praw podstawowych odbyło się głosowanie i wniosek jest jeden – na pewno nie powinniśmy tego robić po raz drugi.
W tekście z Laeken jest tylko jedno jedyne zdanie na temat sytuacji, w której całkowity konsensus między krajami Piętnastki mógłby mieć miejsce, ale o której mogę jedynie marzyć, że się ziści. Lecz to i tak nie dotyczy państw kandydujących. Po pierwsze, nie wydaje mi się, by łatwo było osiągnąć całkowity konsensus pośród 15 państw członkowskich. Po drugie, nie mogę sobie wyobrazić sytuacji, gdzie całkowity albo większościowy konsensus między krajami Piętnastki różniłby się w sposób diametralny od stanowiska krajów kandydujących. Udział krajów kandydujących w konwencie jest ważny również z innego powodu – by kraje te mogły uczestniczyć w „chemii” konwentu. Konwent państw Piętnastki bez udziału krajów kandydujących stałby się powodem do wielu frustracji i źródłem przyszłych problemów. Obecnie, jeśli konwent kończy się jakimiś ustaleniami, są to ustalenia, na które kraje kandydujące miały wpływ. Biuro i Prezydium postarają się zadbać o to, by kraje kandydujące były zapraszane do debaty. Mam również nadzieję, iż, tak jak to ma miejsce w Polsce, pozostałe kraje kandydujące wykorzystają ten konwent do rozpoczęcia podobnej debaty „na swoim podwórku”. Bardzo ważne jest, by społeczeństwo wiedziało, o „co właściwie chodzi w tej Unii Europejskiej”. Jednocześnie z pewnością należy unikać dyskusji o podłożu emocjonalnym, gdyż może to prowadzić do negatywnego wyniku referendum, nawet w niektórych państwach członkowskich. Dyskutanci często zbyt emocjonalnie podchodzą do zagadnienia i z góry nabierają uprzedzeń, nie mających nic wspólnego z rzeczywistością.
Reasumując, czekają nas naprawdę poważne dyskusje w ramach konwentu. Nie śmiem też teraz przewidywać, jakie będą najtrudniejsze kwestie. Natomiast z pewnością mogę powiedzieć, że konwent musi wystrzegać się dyskusji na temat czystych pojęć, sloganów, czy innych pustych frazesów. Na przykład, debata pod hasłem czy chcemy federalnej Europy, czy nie, jest dla mnie pozbawiona sensu, gdyż nikt nie wyjaśnia, co to właściwie znaczy. Rozsądne i konstruktywne dyskusje, to takie, w których zastanowimy się, co chcemy osiągnąć, czy chcemy tego dokonać wspólnie, jak tego dokonamy i czy razem jesteśmy na tyle silni, że uda nam się to osiągnąć. Doświadczenie Unii Europejskiej pokazuje, że aby dokonać czegoś wspólnie, niezbędne są instytucje, które kierują się interesem Europy, który jest czymś więcej niż tylko dodatkiem do interesu narodowego. Muszą to być instytucje umożliwiające taką debatę, na przykład, Rada Unii Europejskiej, gdzie delegaci reprezentują swój naród i gdzie bronią interesów swojego państwa, ale w dialogu z instytucjami uwzględniającymi interes całej Unii. I żeby nie być gołosłownym, podam państwu przykład mojego własnego kraju. Zanim przystąpiliśmy do unii walutowej, odnosiliśmy naszą walutę do marki niemieckiej, a autonomia Belgijskiego Banku Centralnego ograniczała się do zaledwie kilku minut upływających pomiędzy decyzją Deutsche Bundesbanku a ich własną. I mimo iż Bank znajduje się we Frankfurcie, to decyzje, które podejmuje, na przykład, w sprawie wysokości stóp procentowych, uwzględniają interes europejski.
