uvod(ni prijedlog)

Prevodi se kao jednostavno "uvod" ili "uvodni prijedlog," zavisno od konteksta. Zaista ne znam kako da objasnim sta bi "chapeau" znacio jer nije da ga nema u BH pravnom sistemu: "chapeau" nije "opsta odredba" citavom setu clanaka, nego nesto kao uvod, kao pojasnjenje koje se daje specificnom clanu u sklopu tog dokumenta.

Postoji razlika izmedju "uvodne odredbe" i "uvoda":

"Uvodna odredba" je u zakonu. Recimo, lupam, "Zakon o sumama":

Poglavlje I: UVODNE ODREDBE
Poglavlje II: SPECIJALA NAMJENA SUMA
Poglavlje III: ZAVRSNE ODREDBE

E, sad, u ovom poglavlju "uvodne odredbe" autor ce definirati sume kao takve, podijeliti ih na sjecive i ne sjecive, definirati, sta ja znam, ko u vladi ima ingerencije nad sumama i sta ja znam sve.

E, sad, u "chapeau" clanu 1 uvodnih odredaba, autor ce reci "Shodno odlukama vijeca sumara sadrzanog u bla bla, pod pojmom suma u smislu bla bla odredjuje se bla bla," s tim da... e, ovo sto sam stavio u navodnike je taj chapeau, taj uvod u clanak. Autora nabraja, nabraja, nabraja i onda kaze sadrzinu clana, to sto on nabraja je chapeau.

agree John Farebrother : 'Chapeau' je isti kao i preamble, dakle uvod. Postoji vise u medunarodnim ugovorima. Ali dok se 'preamble' cesto tako i naziva, 'chapeau' se moze odnositi na taj dio ugovora ili clana koji se kao uvod moze smatrati, iako nema takvog naslova. 'Chapeau' ina

Prijedlog prijevoda temelji se na sljedećem članku jednog ugovora:

Application of Article XX Chapeau

Once a measure satisfies the conditions set by one of the paragraphs of Article XX, the panel or the Appellate Body has turned to the application of the introductory clause (chapeau) of Article XX. The chapeau requires that in order to be justified under one of the pargraphs of Article XX, measures must not be “applied in a manner which would constitute a means of arbitrary or unjustifiable discrimination between countries where the same conditions prevail, or a disguised restriction on international trade”.
